Appropriations Committee 10/07/08

The Senate Appropriations Committee met on 10-7-08 and reported out the following bills:

HB 1845            The legislation amends Titles 18 (Crimes Code) and 42 (Judicial Code) to provide for changes to the Uniform Firearms Act of 1995, penalties, seizure of weapons and ammunition, the statute of limitations.  Sen. Pileggi offered A9226 that further provides for issuance of temporary emergency licenses to carry.  The amendment was adopted 24-2.  Sen. Pileggi offered A9669 that was technical.  This amendment was adopted 25-1.  Sen. Armstrong offered A9741 that delays transfer of initial funding to fiscal year 2009-10.  The amendment was adopted 26-0.  The bill was reported out of committee 26-0.

HB 2499            This bill establishes the Massage Therapy Board and provides for the licensure of massage therapists.  Sen. Armstrong offered A9742 that further provides that licensures shall not constitute eligibility for insurance reimbursement.  The amendment and bill were reported 26-0.

HB 2525            This bill amends the Dog Law by creating a new definition and standards for commercial kennels; revising provisions related to dangerous dogs; and adding new penalties and enforcement authority.  Sen. Armstrong offered A9766 that makes additional changes regarding the operation of kennels.  The amendment and bill were reported 26-0.

HB 2200            House Bill 2200 amends Title 66 (Public Utilities) to modify the procurement options for utilities to purchase the electricity that they sell.  The bill also allows utilities to sell electricity at real time prices either by customer choice or when current meters are normally replaced.  The bill was reported 23-3.


 

Appropriations Committee 10/06/08

The Senate Appropriations Committee met on 10-6-08 and reported out the following bills:

SB 1112 - The bill amends the Emergency and Law Enforcement Personnel Death Benefits Act by changing when a death certificate must be submitted, and who and how much surviving family members will receive from the Commonwealth.  The bill was reported 26-0.  

SB 1413 - This bill amends Title 75, Vehicle Code, further providing for suspensions or revocations of operating privileges by those under suspension who continue to drive.  The law shall be referred to as Alex’s Law.  Sen. Stout offered A8933 that deletes confiscation provisions.  The bill and amendment were reported 26-0.

SB 1455 - The legislation establishes the Keystone Care Prescription Assistance Program which will enable low-income adults without prescription drug coverage to be linked to an appropriate free or low-cost prescription assistance program.  The bill was reported 26-0.    

SB 1564 - The bill creates the Keystone Care Program (KeyCare) Act to administer and provide grants to an approved health care resource network.  The bill was reported 26-0.  

HB  301 - This bill amends Title 42, section 6333, relating to subpoenas. When a witness who is under 18 years of age is subpoenaed a copy of the subpoena shall be issued to the parent, guardian or other custodian of the witness.  Sen. Greenleaf offered A9657 that establishes new judgeships.  The bill and amendment were reported 26-0.

HB 347 - The bill adds a subsection to allow the Department of Transportation to waive the Commercial Drivers License (CDL) driving test for active duty military or recently discharged veterans with at least two (2) years experience working in Commercial type vehicles as a part of their military job.  Sen. Madigan offered A9674 that meets federal compliance issues.  The bill and amendment were reported 26-0.

HB 420 - This legislation changes the Main Street Act to allow for the grants established in 2002, to be used for residential facades within an established downtown.  Money can also be used for promoting residential opportunities within a Main Street area.  The bill was reported 26-0.     

HB 834 - The legislation establishes the Prohibition of Excessive Overtime in Health Care Act which states that a health care facility may not require an employee to work in excess of an agreed to, predetermined and regularly scheduled daily work shift.  Sen. Armstrong offered A9620 that changes the effective date.     The bill and amendment were reported 26-0.

HB 1214 - This bill would amend Title 34 (Game) to shorten the term of PA Game Commission’s Board members’ terms from eight (8) to four (4) years.  The bill was defeated 12-14 with all Democrats voting against.

HB 1257 - This bill amends the Dental Law to expand the scope of practice for the expanded function of dental assistant and certify the dental assistant.  The bill was reported 26-0. 

HB 1634 - The bill enacts the Uniform Municipal Deed Registration Act which would provide for a more timely process for recording deeds in counties and registering deeds in municipalities.  The bill was reported 26-0.  

HB 2034 - The bill creates the Long-Term Care Patient Access to Pharmaceuticals Act that will provide patients with lower cost drugs through the Veteran’s Administration if they reside in a long-term care facility.  Sen. Armstrong made a motion to revert to the prior printers’ number thus giving veterans greater savings on re-packaging of drugs.  The motion was adopted 26-0 and the bill was reported out 26-0.

HB 2098 - This legislation creates the Preventable Serious Adverse Events Act.  Sen. Stack offered A9204 that was technical and A9319 that further provides for Medicare payment policies.  The bill and amendments were reported 26-0.

HB 2233 - This bill repeals the expiration of the Elm Street Program, which was scheduled to sunset on June 30, 2011.  This bill also allows for grants to be renewed for an additional five years, with DCED approval, after the initial five year period has ended.  The bill was reported 26-0.


 

Appropriations Committee 09/24/08

The Senate Appropriations Committee met on 9-24-08 and reported out the following bills:

SB 1422            This bill amends the Insurance Company Law by adding a new section to authorize Mini-COBRA Small Employer Group Health Policies.  It allows employees or dependents of employees of small employers (2-19 employees) who lose health care coverage through a qualifying event to continue the group health insurance coverage at cost.  The bill was reported 26-0. 

SB 1453            This bill allows for dependent children to receive health insurance coverage through their parent’s policy up to 30 years of age.  The bill was reported 26-0. 

HB 2629            The bill amends the Health Care Facilities Act by setting when final regulations must be established for licensure and operation of small residential hospices.  The bill was reported 26-0. 

HB 647            This measure creates the Board of Crane Operators within the Department of State.  The bill was reported 26-0.



 

Appropriations Committee 09/23/08

The Senate Appropriations Committee met on 9-23-08 and reported out the following bills:

SB 5     The bill establishes the Community-Based Health Care Program (CHC) that will provide grants to community-based health care clinics.  Sen. Pileggi offered A 9270 that  is cleanup language that addresses concerns raised in the Public Health and Welfare Committee.  The amendment and bill were reported 26-0.

SB 147             This bill provides that the Commissioner of Professional and Occupational Affairs can impose a civil penalty of up to $10,000 per violation on any licensee, registrant, certificate holder, permit holder or unlicensed person who violates a lawful disciplinary order.  The bill was reported 26-0.

SB 908             This bill further provides for regulations and licensing requirements on auctioneers, apprentice auctioneers, auction houses, auction companies and trading assistants. The bill was reported 26-0.  

SB 1231            This bill excludes from sale at retail Text Box:  
of repair or replacement parts, including the installation of those parts, exclusively for use in aircraft or in overhauling or rebuilding of aircraft or aircraft components.  Also applies to the sale or lease at retail of aircraft. The bill was reported 26-0.

 

SB 1258            This bill amends the Fourth to Eighth Class and Selective County Assessment Law further providing for appeals by municipalities. The bill was reported 26-0.

SB 1400            This bill would amend the Housing Finance Agency Law to create the Pennsylvania Housing Affordability and Rehabilitation Enhancement Program.  Sen. Pippy offered A9292 that removes the $10 million appropriation.  The amendment and bill were reported 26-0.

SB 1584            Senate Bill 1584 establishes the Protecting Pennsylvania’s Investment Act, which prohibits the investment of state retirement funds in private entities that actively do business in Sudan and Iran.   Sen. Armstrong offered A9380 that was technical.  The amendment was reported 26-0 and the bill was reported 23-3. 

SR 309             This resolution directs the LB&FC to conduct a fiscal impact study on the pension and postretirement health benefits of the Pennsylvania Public School Employees’ Retirement System and the Pennsylvania State Employees’ Retirement System.  Sen. Armstrong offered A9163 that changes the due date for the report.  The amendment and bill were reported 26-0.

HB 2188            This bill would establish the Abandoned and Blighted Property Conservatorship Act. The act would allow for court-appointed conservators to bring residential, commercial and industrial buildings into municipal code compliance when owners fail to do so.  Sen. Pippy offered A9310 that further provides for bids for contracts by conservators.  The amendment and bill were reported 26-0.


 

Appropriations Committee 09/17/08

The Senate Appropriations Committee met on 9-17-08 and reported out the following bills:

SB 1503            This bill provides for the adoption of capital projects related to the repair, rehabilitation or replacement of highway bridges.  Sen. Armstrong offered A9105 that provides for additional projects.  The amendment and bill were reported 26-0.

SB 1504            The bill is designated as the Highway Capital Budget Project Itemization Act of 2008-2009.  The Act would provide authorization to spend moneys in the Motor License Fund for highway capital projects.  Sen. Armstrong offered A9103 that provides for additional projects.  The amendment and bill were reported 26-0.

HB 1511            This bill amends Title 42 to provide for filings and notification in child custody hearings.  This bill will add the provision for the creation of a comprehensive adjustment report for the use at these types of hearings.  The bill was reported out 26-0.

HB 1742            The bill would require scrap dealers or recycling facility operators to establish corporate accounts from those they buy scrap from so that there is a method to track the sale of scrap to discourage theft of metals that are becoming much more valuable due to higher commodity prices.   Sen. Logan offered A8635 that modifies the bill regarding definition of buyer and law enforcement officer and further provides for disposition of scrap material.  The amendment and bill were reported 22-4.


 

Appropriations Committee 07/04/08

The Senate Appropriations Committee met on Friday, July 4, 2008 and reported out the following bills:

HB 1067 - This bill amends the Public School Code of 1949 to require that a student’s disciplinary record be transferred to another school – public or nonpublic – upon the transfer of a student.  Sen. Armstrong offered an amendment that places background check language into the bill.  The bill and amendment were adopted 26-0.


 

Appropriations Committee 07/03/08

The Senate Appropriations Committee met on Thursday, July 3, 2008 and reported out the following bills:

HB 377 - This bill is a tax code bill that was gutted by the Senate Finance Committee and replaced with language from SB 1385, SB 1386, SB 1387, and SB 1388.  All four bills previously passed the Senate.  Net Operating Loss (SB 1385).  Special Tax Forgiveness (SB 1386)  Section 179 Expenses (SB 1387)  Sales Factor (SB 1388).  Sen. Browne offered A8774 that adds language for the Volunteer Responder Retention and Recruitment Tax Credit The amendment and bill were reported 26-0.

HB 1199 - This bill amends the Physical Therapy Practice Act to further provide for the State Board of Physical Therapy and its powers and duties.  Sen. Tomlinson offered A8017 that is technical.  The bill and amendment was reported 26-0.

HB 2231 - This Bill increases the limit on redevelopment assistance capital projects debt outstandingSen. Armstrong offered A8754 that provides $200 million over a 4 year period.  The bill and amendment were reported 26-0.

HB 2294 - This bill provides for the licensing of debt management services.  The bill was reported 25-1.

HB 2522 - House Bill 2522 provides for the Capital Budget Act of 2008-2009.  Sen. Armstrong offered A8410 that inserts Rebuild PA into the program.  Sen. Wozniak offered A8612 that provides $35 million for Appalachian funding.  The amendments and bill were reported 26-0. 

SSHB 1 - This bill sets forth the powers and duties of the Pennsylvania Energy Development Authority (Authority); consolidates provisions of The Administrative Code of 1929 relating to the Energy Development Authority and emergency powers; allocates funds to be used by the authority; and allows the authority to issue negotiable bonds and other forms of indebtedness for certain alternative and renewable energy projects.  Sen. Armstrong offered A8758 that guts the bill and replaces it with the Alternative Energy Investment Act language.  The amendment and bill were reported 26-0.

HB 2167 - This bill authorizes the city of Philadelphia to impose a Philadelphia hospitality promotion tax.  Sen. Logan offered A8656 that provides for hotel taxes in Allegheny County.  The amendment was reported 26-0 and the bill was reported 24-2.


 

Appropriations Committee 07/02/08

The Senate Appropriations Committee met on Wednesday, July 2, 2008 and reported out the following bills:

SB 1203 - This legislation amends the Probate, Estates and Fiduciaries Code (Title 20).  Sen. Greenleaf offered A7739 that adds clarification language.  The bill and amendment were reported unanimously.

SR 243This resolution would direct the Joint State Government Commission to conduct a study of state law and school policies and practices regarding the notification of parents when a student violates a public or private institution of high education’s drug and alcohol policy.  The resolution was reported unanimously.

HB 4 - This bill amends Title 42  and Title 44 to further provide for the sentencing, re-sentencing, incarceration, probation and parole of certain offenders in the Commonwealth.  Sen. Rafferty offered A7746 that provides for district attorney approval RRRI sentencing.  The bill and amendment were reported unanimously.

HB 6 - The legislation authorizes the Pennsylvania Commission on Sentencing to adopt guidelines, similar to current sentencing guidelines, for use in parole, probation or intermediate punishment decisions.  The bill was reported unanimously.

HB 306 - This legislation would remove the jurisdiction of the court of common pleas for appeals of determinations issued by the Pennsylvania Labor Relations Board under the Pennsylvania Labor Relations Act (PLRA).  Sen. LaValle offered A8257 that provides for statewide jury lists for statewide courts.  The bill and amendment were reported unanimously.

HB 747 - This bill would amend Title 34 (Game) authorizing the Pennsylvania Game Commission to auction one special, elk-hunting license annually.  Proceeds will go toward elk habitat improvements.  Sen. Armstrong offered A8564 that is technical.  The bill and amendment were reported unanimously.

HB 883 - The legislation amends the Newborn Child Testing Act by listing additional diseases that newborn children will be tested for and receive follow-up services.  Sen. Armstrong offered A7948 that is technical.  The bill and amendment were reported unanimously.

HB 1202 - This bill creates the Clean Fuels and Energy Independent Act.  This bill would establish minimum content standards and timetables for the sale of bio-diesel and ethanol within Pennsylvania.  Amendment A8594 was offered that would adds Biofuel Development and In State Production Incentive Act.  The bill and amendment were reported unanimously.

HB 1438 - This bill provides for repeals by corporate authorities.  It limits the circumstances under which a taxing district may appeal an assessment.  The bill was reported unanimously.

HB 1693 - This bill amends the Social Workers, Marriage and Family Therapists and Professional Counselors Act to endorse out-of-state licensed clinical social workers, marriage and family therapists, and professional counselors and provide title protection to the use of “social worker”.  The bill was reported unanimously.

HB 1705 - This bill authorizes Pennsylvania to join the Great Lakes-St. Lawrence River Basin Water Resources Compact (compact).  The bill was reported unanimously.

HB1788 - The bill amends the Public Welfare Code by requiring the department to post information on its Internet website relating to the licensure and inspection of personal care homes.  Sen. Armstrong offered A8611 that adds additional provisions concerning Medicaid and hospital assessments.  The bill and amendment were reported unanimously.

HB 2458 - This bill makes appropriations from the restricted revenue accounts within the State Gaming Fund and from the State Gaming Fund to the Pennsylvania Gaming Control Board, the Department of Revenue, the Pennsylvania State Police and the Attorney General for fiscal year 2008-09.  Sen. Armstrong offered A8644 that alters appropriations.   The bill and amendment were reported unanimously.

HB 2648 - The bill extends the Health Care Cost Containment Council until June 30, 2013.  It also establishes a Health Care Cost Containment Council Act Review Committee.  Sen. Armstrong offered A8608 that further provides for the HCCCC and Mcare abatement.  The bill and amendment were reported unanimously.

HB 2313-2338 @HB 2340-2342 - These bills would appropriate $780.8 million to those non-state owned institutions known as “non-preferreds.”  Sen. Armstrong offered a variety of amendments to these bills that alter the funding.  Museum cuts 23-3.  Education cuts 25-1.  Beacon Lodge 26-0.  Pitt, Penn St, Temple and Lincoln 26-0.  Sen. Wozniak offered amendments that would include funding for additional museums, those amendments were rejected 10-16.

HB1116 - The bill provides for the sale of vouchers for hunting licenses and permits.  The bill was reported  26-0.

HB 1788 - This bill creates the Personal Care Homes Licensing and Inspection Reporting Act.  Sen. Pileggi offered A8408 that converts the bill from a free standing act to a Public Welfare code amendment.  The amendment and bill were reported 26-0.

HB  2458 - This bill makes appropriations from the restricted revenue accounts within the State Gaming Fund and from the State Gaming Fund to the Pennsylvania Gaming Control Board, the Department of Revenue, the Pennsylvania State Police and the Attorney General for fiscal year 2008-09.   The bill was reported 26-0. 

HB 2522 - This bill provides for the Capital Budget Act of 2008-2009.  The bill was reported 26-0.

Appropriations Committee 06/28/08

The Senate Appropriations Committee met on Saturday, June 28, 2008 and reported out the following bills:

SB 1497 - The bill amends the Public Welfare Code by defining certain terms and requiring that the department consider pharmaceutical services as a covered benefit under both mandatory managed care and voluntary managed care.  The bill was reported 26-0.

SB 1499 - This legislation creates a statutory policy for the use of state owned vehicles.  The bill was reported 26-0.

HB 5 - This legislation provides for the temporary transfer of inmates in the custody of the Department of Corrections for judicial proceedings.  Sen. Rafferty offered A7614 that is technical.  The amendment and bill were reported 26-0.

HB 1804 - This bill amends the Medical Practice Act to enable a respiratory therapist to become licensed by the State Board of Medicine and to obtain title protection.  Sen. Pileggi offered A8136 that includes scope of practice language.  The amendment and bill were reported 26-0.

HB 2088 - This bill amends the Osteopathic Medical Practice Act to enable a respiratory therapist to become licensed by the State Board of Osteopathic Medicine and to obtain title protection.  Sen. Pileggi offered A8135 that includes scope of practice language.  The amendment and bill were reported 26-0.


 

Appropriations Committee 06/27/08

The Senate Appropriations Committee met on Friday, June 27, 2008 and reported out the following bills:

SB 4 - The bill amends the State Lottery Law by allowing persons who are enrolled in the PACENET program as of December 31, 2007 or December31, 2008 for those enrolled in the PACE program to remain eligible for these programs until December 31, 2010. 

SB 1247 - This bill provides for appeals by municipalities.  It limits the circumstances under which a taxing district may appeal an assessment.

HB 1150 - This legislation mandates insurance coverage for autism spectrum disorders and colon cancer screenings; outlines statutory requirements for the Blues Merger; raises the admitted assets investment cap and makes changes for shareholders of domestic insurers.  Sen. Armstrong offered A8179 that was technical.

Appropriations Committee 06/26/08

The Senate Appropriations Committee met on Thursday, June 26, 2008 and reported out the following bills:

SB 903 - This bill requires that most consulting contracts entered into by the Commonwealth be competitively bid if they are in excess of $25,000.  Contracts that are less than $25,000 shall be assigned to qualified bidders on a rotating basis.  Sen. Pileggi offered A8091 that provides that Attorney General shall not delegate its responsibility for form and legality review.  The amendment and bill were reported unanimously.

SB 1397 - This legislation would amend the Public School Code of 1949 to provide for the liability and enforcement of payments for tuition for those children who are inmates in an institution.  The was reported 23-2.

SB 1421 - The legislation amends the Public Welfare Code by requiring proof of general liability insurance when applying for a registration certificate as well as the posting and providing in writing certain records at a family day care home.  Sen. Armstrong offered A7679 that was technical.  The amendment and bill were reported unanimously.

HB 1067 - This bill amends the Public School Code of 1949 to be included in the Safe Schools section, to require that a student’s disciplinary record be transferred to another school – public or nonpublic – upon the transfer of a student.  The bill was reported unanimously.


 

Appropriations Committee 06/25/08

The Senate Appropriations Committee met on Wednesday, June 25, 2008 and reported out the following bills:

SB 1276 - This legislation provides for the licensing of credit counseling agencies.  Sen. Browne offered A8015 that is a rewrite of the bill.  The amendment and bill were reported 26-0.

SB 1372 - The bill extends the Health Care Cost Containment Council until June 30, 2013 among other changes.  Sen. LaValle offered A7891 that deals with the effective date of new provisions.  The amendment and bill were reported 26-0.

SB 1510 - This bill bill makes appropriations from the restricted revenue accounts within the State Gaming Fund and from the State Gaming Fund to the Pennsylvania Gaming Control Board, the Department of Revenue, the Pennsylvania State Police and the Attorney General for fiscal year 2008-09.   The bill was reported 26-0.


 

Appropriations Committee 06/24/08

The Senate Appropriations Committee met on Tuesday, June 24, 2008 and reported out the following bills:

SB 1158 - This bill is designed to amend Title 74 (Transportation) to provide for Public Private Partnerships (P3s or PPP) as defined by the federal government.  The bill was reported unanimously.

SB 1337 - The bill establishes the Medical Assistance Pharmacy and Therapeutics Committee within the Department of Public Welfare.  The committee will serve the secretary in an advisory capacity to develop and maintain a preferred drug list and drug utilization review controls for prescription drugs and medical devices.  Sen. Armstrong offered A7953 that clarifies that discussions with any stake holder does preclude a committee member from voting, further provides for open meetings and for notice of any limitation on the acceptance or submission of testimony.  The amendment was asopted unanimously.  The bill was reported 16-10 with Democrats voting against.

HB 2302 - This bill creates the Tourism Promotion Act to provide for financial assistance to agencies promoting tourism in Pennsylvania and repeals Act 50 of 1961 known as the Tourist Promotion Law.  The bill was reported unanimously.


 

Appropriations Committee 06/23/08

The Senate Appropriations Committee met on Monday, June 23, 2008 and reported out the following bills:

SB 1266 - This bill would amend the Breach of Personal Information Notification Act to provide for a public notice of a security breach within seven days.

SB 1330 - This bill creates a mediation board to help settle disputes arising between drillers of coal bed methane and the owner of the surface property.  Sen. M.J. White offered A7220 that changes appointment process, clarifies DEP’s authority and changes permit application date.

SB 1370 - This legislation amends the Insurance Company Law of 1921.  Specifically, it makes changes to section 1405, which addresses Standards and Management of an Insurer with a Holding Company System. 

HB 7 - This legislation provides for the removal of prisoners who are seriously or terminally ill.  Sen. Rafferty offered A7613 that makes technical corrections, requires electronic monitoring by department for all early release prisoners and clarifies who is a seriously ill prisoner.

HB 1096 - The bill amends the Pennsylvania Construction Code Act by establishing The Uniform Construction Code Review and Advisory Committee. 

HB 1612 - This bill provides for established testing standards for cigarette fire safety, as well as the certification of compliance by manufactures and for the enforcement and penalties. It also establishes a special fund found within the State Treasurer.

HB 2179 - This bill requires the licensing of mortgage lenders, correspondents and brokers.  Sen. Stack offered A7542 that is technical.

Appropriations Committee 06/16/08

The Senate Appropriations Committee met on Monday, June 16, 2008 and reported out the following bills:

SB 546 - This bill adjusts the funds appropriated to County Fairs within the Department of Agriculture and for the Cultural Expositions and Exhibitions within the Department of Community and Economic Development in the 2005-06 fiscal year.  Sen. Armstrong offered A7555 that is essentially SB 1389 which is the supplemental appropriation bill for FY 2007-08.  The amendment and bill were reported 26-0.

SB 1062 - The bill would allow the Secretary of DEP to enter into agreements with developers to clean up brownfield sites so that they can be redeveloped into productive construction projects.  The Secretary may agree to reimburse the developer up to 75% of the cost of the actual remediation costs.  Sen. Armstrong offered A7570 that takes into account coal remdiation and makes several technical changes. The amendment and bill were reported 26-0.

SB 1341 - This bill, the “Water and Sewer Systems Assistance Act” would authorize a bond referendum in the amount of $400 million to be used for improvements to drinking water and wastewater treatment systems.  If this were to be approved by voters, the bond money would be administered through the Pennsylvania Infrastructure Investment Board (PennVest).  Sen. Armstrong offered A7522that authorizes the use of bond proceeds for loans or grants to a public utility for the acquisition of small water or sewer utilities under certain circumstances.  The amendment and bill were reported 26-0.

SB 1389 - This bill would provide supplemental appropriations for 2007-08 fiscal year.  Sen. Armstrong offered A7611 that guts the bill and offers the Senate Republican version of the general appropriation act for the coming fiscal year.  It reduces the education budget that the governor proposed by $118 million.  The amendment and bill were reported 16-10, with all Democratic members voting against.

SB 2 - This bill provides for the allocation of money from the Pennsylvania Gaming Economic Development and Tourism Fund for funding water and sewer infrastructure, flood control, and high hazard dam projects.  Sen. Pileggi offered A7473 that increases bond authorization to $800 million.  The amendment was reported unanimously.  Sen. Wozniak offered A7404 that prohibits Allegheny and Philadelphia counties from spending additional monies until the remaining counties receive their share first.  The amendment was adopted 25-1.  The bill was reported unanimously 26-0.

SB 1050 - This bill expands the remediation of used tires by increasing the amount of money going to those efforts for the next five years.  Sen. Armstrong offered A7337 that was technical.  The amendment and bill were reported unanimously.

SB 1169 - This bill allows local governments to establish a $400 tax credit for the earned income tax for volunteer firefighters and volunteer rescue personnel.  The bill was reported unanimously.

SB 1385 - This bill would raise the cap on NOL’s that limits each corporation to an annual deduction of $5 million or 20% of the corporation’s taxable income.  Sen. Corman offered A7325 that was technical.  The amendment and bill were reported unanimously.

SB 1386 - This bill would allow more taxpayers to benefit from the poverty forgiveness provisions of the personal income tax (PIT) by increasing the amount of income that would be exempt from taxation over the next three years.  The bill was reported unanimously.

SB 1387 - The bill amends the tax reform code to raise the value of section 179 property that can be expensed from the personal income tax from $25,000 to $50,000.  The bill was reported unanimously.

SB 1388 - This bill amends the corporate net income tax to increase the sales factor apportionment formula from 70% to 80%.  Sen. Browne offered A7326 that was technical.  The amendment and bill were reported unanimously.

SB 1412 - This bill would amend the Keystone Opportunity Zone, Keystone Opportunity Expansion Zone and Keystone Opportunity Improvement Zone Act providing for extensions, substitution of parcels outside a subzone, and for sales and use tax provisions related to the corporate income tax.  Sen. Pippy offered A7341 that further provides for extensions and for relief from local taxation.  Sen. Scarnatti offered A7355 that prohibits employment of illegal aliens in a KOZ.  Sen. Fumo offered A7360 that provides for Philadelphia provisions.  The amendments and bill were reported unanimously.

SB 1093 - Senate bill 1093 clarifies that surviving spouses of police officers are to receive a portion of the officer’s pension benefits under Act 30 of 2002 even if the officer had retired or died prior to the effective date of the act.  Sen. Armstrong offered A6983 that is technical.

SB 1373 - The bill is the Mental Health and Mental Retardation Maintenance of Community Services Act.

SR 31 - The resolution recognizes the Philadelphia Health Management Corporation as a Pennsylvania Public Health Institute.  Sen. Armstrong offered A6853 that provides that recognition does not give special fiscal consideration to the corporation.

HB 775 - This legislation would amend the counties of the First Class to require all honorably discharged veterans to receive markers on their graves.

HB 776 - This legislation would amend the County Code (first, third, fourth, fifth, sixth, seventh, and eighth counties) to require all honorably discharged veterans to receive markers on their graves.

HB 777 - This legislation would amend the Second Class County Code to require all honorably discharged veterans to receive markers on their graves.

SB 1225 - The bill creates a system of Intrastate Mutual Aid between participating political subdivisions within Pennsylvania.  The system will provide for mutual assistance among the subdivisions in the prevention of, response to and recovery from threats to public health and safety that are beyond the capability of an affected community to respond.  Sen. Pippy offered A5997 that adds coroners and Hazmat team members to the Interstate Mutual Aid Committee.  The amendment and bill were reported 25-0.

SB 1278 - This bill enhances the Pennsylvania Child Support Enforcement Program by: providing more support to low-income families, reducing operational costs, and generating revenue through increased Federal incentive earnings.  The bill was reported 25.0.

SB 483 - This bill amends the Loan Interest and Protection Act by raising the coverage of the Act to all residential mortgages under $200,000 from the Banking Department’s maximum interest rate limits.  The bill also gives the Banking Department more enforcement powers and increases the fine for violating the usury laws.

SB 484 - This bill amends the Banking Department Law by allowing the Department to require licensees to enter information in a national electronic licensing system as part of the licensing process.  The bill also allows additional views to be heard at administrative hearings conducted by the Department on charter changes.  Sen. Browne offered A5744 that was technical.

SB 485 - This measure provides penalties for those who perform real estate appraisals but are not state certified.  The composition of the Real Estate Appraiser Board is changed by including six state certified Real Estate Appraisers.  Formerly, the Board had four members who were Real Estate appraisers but were not state certified.  Sen. Browne offered A5249 that provides compliance language with federal law.

SB 486 - This legislation would amend the Housing Finance Agency Law, further providing for the Homeowner's Emergency Assistance Program, for notice and institution of foreclosure proceedings, for notice requirements, for assistance payments and for repayment; and providing for an ongoing foreclosure study.  Sen. Browne offered A4589 that was technical. 

SB 487 This bill  amends the Mortgage Bankers and Brokers and Consumer Equity Protection Act by requiring the Banking Department to license the individuals who are in the business of arranging first mortgage loans.  Sen. Browne offered A5018 that was technical.

SB 488 - This bill amends the Secondary Mortgage Loan Act by requiring the Banking Department to license the individuals who are in the business of arranging secondary mortgage loans.  Sen. Browne offered A5743 that was technical.

HB 1691 - This bill holds the United States Army Corps of Engineers free from damages that may occur during the deep dredging of the Delaware River.


 

Appropriations Committee 01/29/08

The Senate Appropriations Committee met on 1-29-08 and reported out the following bills:

SB 949 - This bill  establishes the “Bituminous Coal Mine Safety Act” and is an extensive revision of Pennsylvania’s underground mine safety law.  The bill creates additional responsibilities for DEP and for the mine operators.  Sen. White offered three separate amendments, A55492, A5512 and A5533.  All three amendments were clarifying technical amendments that were agreed to by all parties involved including DEP.  The amendments and bill were reported from committee 26-0.

SB 1019 - This bill amends the Board of Vehicles, Dealers and Salespersons Act to add a definition involving “recreational vehicle shows, off-premise sales, exhibitions and rallies” to address the issue of sales activities by out of state recreational vehicle dealers.  Sen. Gordner offered A5442 that is a technical re-write of the bill.  The amendment and bill were reported 26-0.

SB 1063 - This bill would provide for the consolidation of local income tax collection systems into a county based system for municipalities and local school districts.  Sen. Browne offered A5472 that would eliminate the Attorney general from the enforcement process in the bill and corrects drafting oversights.  The amendment was agreed to with a 21-4 vote and one member abstaining.  However, the bill received a 13-13 and failed to be reported from committee.  Opposition from both sides of the aisle expressed concern that the bill would not streamline the taxing process and actually make it more cumbersome.

SB 1122 - This bill requires that no commonwealth employees may be furloughed because the general appropriation act has not been passed before the beginning of the fiscal year.  The bill was reported 26-0.

SB 313 - This bill amends the Pharmacy Act to create the registration and qualifications for a pharmacy technician.  Sen. Armstrong offered A5361 that was technical.  The amendment and bill were reported 25-0.

SB 987 - The bill provides third class cities with the power to require an itemized list of the expenditures made by emergency service organizations for the monies received from the city.  The bill was reported 24-1.

SB 1023 - This bill would regulate the right to practice acupuncture.  Additionally, it provides for the registration of acupuncturists and establishes a penalty to those who violate the provisions of this Act.  The bill was reported 23-2.

HB 500 - This bill amends the State Board of Medicine to license perfusionists and gives the State Board of Medicine the authority to promulgate regulations necessary for implementation.  The bill was reported 23-2.

HB 501 - This bill amends the Osteopathic Medical Practice Act of 1985 to license perfusionists and gives the State Board of Osteopathic Medicine the authority to promulgate regulations necessary for implementation.  The bill was reported 23-2.

HB 1131 - The bill requires that Second Class Townships be responsible for fire and emergency medical services that are provided within the township.  The bill was reported 24-1.

HB 1133 - This bill would amend the Borough Code to provide that all boroughs shall be responsible for fire, emergency and medical services. The bill was reported 23-2.

HB 1134 - This bill requires that First Class Townships be responsible for fire and emergency medical services that are provided within the township.  The bill was reported 24-1.

The Senate Appropriations Committee met on 12-10-07 and reported out the following bills:

SB 776 - This bill allows a county board of elections to be notified of the death of residents for the purpose of updating voter registration records.  The bill was reported unanimously.

SB 1027 - The legislation authorizes the Department of Corrections at the time the department takes custody of an offender and evaluates them for classification as an offender who would have been otherwise eligible for participation in the State Intermediate Punishment program.  The department is authorized to recommend to the sentencing court that the offender be re-sentenced for participation in the program.  The bill was reported unanimously.

SB 1135 - This bill provides that the State Police test the speed timing devices one year prior to an alleged violation.  Prior to this measure, the State Police was required to have the speed timing devices calibrated 60 days prior to an alleged violation.  Sen. Rafferty offered A4806 that adds speedometers to the bill.  The amendment and bill were reported unanimously.

HB 489 - This measure reduces the number of continuing education hours for a volunteer license performing nursing activities.  Sen. Pileggi offered A5105 that adds the Mcare Act to the bill.  The amendment was adopted 18-4 and the bill was reported out 18-4.

HB 1109 - This bill amends Title 30 (Fish) by adjusting the period limiting the issuing of one-day resident and one-day tourist fishing licenses from March 15th to April 30th.  The current limitation on the availability of one-day licenses is from April 1st to April 30th.  Sen. Armstrong offered A5037 that changes the effective date of the bill.  The amendment and bill were reported out unanimously. 

HB 1961 - The bill amends the Child Protective Services Law of the Domestic Relations Code making a number of changes relating to background checks.  The bill was reported unanimously. 

SS SB 22 - This bill amends the Alternative Fuels Incentive Act (Act 178 of 2004) to increase the reimbursement for the production of renewable fuels and to provide funding for education.  Sen. Gordner offered A5130 that provides an incentive program for biodiesel producers.  The amendment was adopted unanimously.  Sen. Fumo offered A4471 that allows automotive service providers to receive grants for nitrogen tire inflation program.  The amendment was adopted unanimously.  Sen. Tomlinson made a motion to table Sen. Costa’s amendment that would have provided additional funding for vehicle rebates.  The amendment was tabled 15-10.  Sen. Costa made a motion to reconsider the vote on the Gordner amendment but the motion failed 11-14.

SS SB 36 - This bill creates the “Biodiesel Study and Production Incentive Act”.  Sen. Tomlinson made a motion to table two separate Sen. Fumo amendments, one would eliminate a renewable diesel program and the other would provide for carbon sequestration.  Both amendments were table along party lines, 15-10.  The bill was reported from committee 22-3.

SB 711 - This bill would create an act prohibiting the deceptive installation of spyware, providing for criminal and civil enforcement, and providing for civil immunity.  Sen. Gordner offered A1272 that removes provisions of the bill as it relates to the Attorney general and Unfair trade Practice Act.  The amendment and bill were reported 26-0.

SB 826 - This bill maintains a minimum 4% contribution rate for the commonwealth to the state employee’s retirement system (SERS) for fiscal year 2007-08 and each year thereafter.  Sen. Armstrong offered A4511 that maintains increases the SERS ECR from 4% to 5% and maintains the PSERS ECR at 7.13%.  The amendment and bill were reported 26-0.

SB 880 - This bill allows the Fish and Boat Commission could make available, at its offices or through their licensing agents, vouchers for fishing licenses and permits that could be purchased on behalf of a third party.  The bill was reported 26-0.

HB 131 - This bill prevents a municipality from charging a fee or seek reimbursement of costs incurred as a result of municipal police responding to a motor vehicle accident.  This shall not be in effect from those fees allowed by state law arising from accident reporting.  Sen. Regola offered A3776 that clarifies what fees may be charged.   The amendment and bill were reported 26-0.

HB 606 - The bill amends the Liquor Code by requiring managers to undergo Responsible Alcohol Management Training and increases fines that can be imposed upon a licensee.  The bill was reported 25-1.


 

Appropriations Committee 11/28/07

The Senate Appropriations Committee met on 11-28-07 and reported out the following bills:

SB 1147 - The legislation requires all applicants for employment to child care facilities to obtain federal criminal history record information including a set of fingerprints.  It also requires self-employed family day care providers and persons seeking to operate childcare services to submit this information.  The bill was reported 26-0.

SB 1156 - The bill amends the Juvenile Act to provide for certain rights of an individual providing foster care.  This legislation amends Title 42 to insure that foster parents, pre-adoptive parent or relative providing care for the child is provided with the right to be heard at any hearing concerning the child.  The bill was reported 26-0.

SS SB 1 - This bill is a version of the Governor’s Energy Independence Strategy.  The bill provides for tax credits for alternative energy projects and for a $250 million bond for the development of alternative and renewable energy technologies, venture capital, and pollution control technologies.  Sen. Tomlinson offered A4466that guts the bill and inserts the Senate version of the Alternative Investment Energy Act.  Committee members voted to move the amendment and bill with the understanding that the bill will undergo further work and a compromise from both sides of the aisle can be reached.  It was the Committees intention to have a final version in place and be ready to run by the end of next week.  The amendment was adopted 24-2 and the bill was reported out 25-1.

SB 465 - This legislative measure requires that an innkeeper require prospective employees to undergo a criminal history record check and that these be kept on record.   Sen. Pippy offered A4198 that exempts lodging establishments with 20 or fewer rooms.  The amendment was adopted 26-0 and the bill over as amended.

SB 778 - This bill creates the Long-Term Care Patient Access to Pharmaceuticals Act.  Patients will have the ability to acquire lower costs drugs if they reside in a long-term care facility as well as the repackaging and re-labeling of unit doses.  Sen. Armstrong offered 4342 that clarifies that only veterans are eligible for the program.  The bill and amendment were reported 26-0. 

SB 838 - The bill amends the CPA Law further providing for definitions for the State Board of Accountancy, for administrative powers, fees, and licensing and peer review.  Sen. Corman offered A4097 that uniforms rates for compliance and peer reviews.  The bill and amendment were reported 26-0.

SB 1069 - This bill requires each of the Departments and agencies that award Key 93 money to provide a list of the successful applicants and amounts of money awarded to each.

SB 1100 - This bill provides three and a half years of funding for the Hazardous Sites Clean-up Fund (HSCA). 

SB 1137 - This bill makes changes to the Medical Care Availability and Reduction of Error (Mcare) Act including establishing a new fund that will be known as the Mcare reserve Fund.  Sen. Armstrong offered A3972 that deals with the effective date, coverage limitations and actuarial study considerations.  Sen. Armstrong also offered A3897 that maintains eligibility abatement for birthing centers.

SB 117 - This bill changes the status of the Juvenile Court Judges Commission (JCJC) from an independent entity into a commission under the control of the Office of General Counsel (OGC).  Sen. Armstrong offered A3336 that would eliminate continuing appropriation language.

SB 915 - The legislation amends Title 51 (Military Affairs) by providing that the Department makes grants available to designated veterans’ service organizations to support veterans’ service officer programs.  Sen. Armstrong offered A3330 that deletes restricted account and technical decisions.

SB 96 - This bill would establish a grant program within the Governor’s Center for Local Government Services encouraging volunteer emergency service organizations to form partnerships or associations to regionalize, consolidate, and/or merge.  Sen. Armstrong offered A3254 that is technical. 

SB 777 - This bill changes the date that taxes for local governments become delinquent and also includes new fees that can be collected under the provisions of the municipal claim and tax lien law.  This bill does not impact jurisdictions in first or second class counties. 

SB 805This legislation would require the Pennsylvania Department of Education (PDE) to make an annual report to the chairmen and minority chairmen of the House and Senate Education and Appropriations Committees regarding the educational assistance program.

HB 1295 - House Bill 1295 amends the Fiscal Code to provide that all of the money deposited in the Keystone Recreation, Park and Conservation Fund (Keystone Fund) in 2006-07 be transferred to the State System of Higher Education. The bill also provides for the budget implementation language and The Commonwealth Group Life Insurance Plan.  The bill was reported 25-0 and 1 member not voting.

HB 1631 - This bill, the Pennsylvania Gaming Economic Development and Tourism Fund Capital Budget Itemization Act for 2007-2008.  Original projects from Act 71 are included in this bill as well as the new hockey arena for the City of Pittsburgh.  The bill was reported 21-5.

HB 1590 - The Pennsylvania Turnpike Commission would enter into a 50-year lease agreement with PennDOT.  The Commission would make payments to PennDOT for the rental of I-80.  PennDOT would use these payments in order to fund Transit and the Highway and Bridge Program.  Sen. Madigan and Fumo offered A3113 that make numerous technical changes as well as several agreed to clarifying changes.  The amendment was agreed to unanimously and the bill was reported 17-7.

SB 546 - This bill makes an appropriation to the Dept. of Agriculture.  The bill was reported  24-0.

HB 1251            This bill amends the Medical Practice Act to limit to no more than four physician assistants for whom a physician has responsibility or supervision at any time.  Sen. Tomlinson offered A2772 that is technical.

HB 1252            This bill amends the Osteopathic Medical Practice Act to limit to no more that four physician assistants for whom a physician has responsibility or supervision at any time.  Sen. Tomlinson offered A2770 that is technical.

HB 1253            This bill amends the Professional Nursing Law to allow a certified registered nurse practitioner to take on added duties provided that they are acting within the scope of the nurse practitioner’s collaborative or written agreement with a physician and the nurse practitioner’s specialty certification.

HB 1254            This bill amends the Professional Nursing Law to provide for certification of clinical nurse specialists (CNS’s).  Sen. Tomlinson offered A2747 that is technical.

HB 202 - Under current law cities of the first class operate under specific rules regarding the attendance to and removal of vehicles determined to be abandoned.  This bill would include 2nd class cities (Pittsburgh).  The bill was reported unanimously 26-0.

HB 896 - The bill amends the Liquor Code by allowing limited wineries to obtain a special permit for use at farmers markets as well as wine, food and cultural expositions.  Sen. Rafferty offered A2535 that clarifies language for special occasion permits, selling wine at farmers markets, hotel licenses and specific instances.  The amendment and bill were reported 26-0.

HB 1590 - This is the transportation funding bill. It permits Allegheny County to impose a 10 percent alcohol tax or a $2 car rental tax, but removes the other local taxation options, reduces local match requirements from 20 to 15 percent, requires the turnpike to raise fares one year earlier, in 2009 and removes language changing membership of SEPTA’s board.  Sen. LaValle offered A2531 that replaces and clarifies language.  Sen. Armstrong offered A2563 as an amendment to the LaValle Amendment, which was technical.  Both amendments were agreed to 26-0.  The bill was reported out 19-7.

HB 1287 - This bill makes appropriations to the Pennsylvania Gaming Control Board, and the Attorney General, the Department of Revenue and the Pennsylvania State Police for their duties in regards to the gaming law.  Sen. Tomlinson offered A2481 that increases certain appropriations.  The amendment and bill were reported 26-0.

HB 1295 - This bill amends the Fiscal Code to provide that all of the money deposited in the Keystone Recreation, Park and Conservation Fund (Keystone Fund) in 2006-07 be transferred to the State System of Higher Education.  Sen. HB 966 - The legislation amends the Insurance Company Law to further provide for hospital plan corporations and professional health services plan corporations and for consolidations under the Insurance Holding Company Act.  It provides the Insurance Department with additional tools to review, approve, or disapprove consolidations of Blue Cross/Blue Shield companies.  It also amends the definition of Long Term Care Insurance and provides for long term care insurance coverage through the Guaranty Fund.  Sen. Pileggi offered A2496 that further provides when an order may be entered.  The amendment was accepted.  The bill was reported out 23-2.

SB 704 - The bill amends the Public Welfare Code by adding two members to the Intra-Governmental Council on Long-Term Care as well as defines various terms including assisted living residence, supplemental health care service, etc.  It also requires the appointment of administrators and creates regulations.  The bill establishes an application fee. Sen. Vance offered A2282 that removes requirements that the commission is self funded.  The amendment and bill were reported 25-0.

HB 10 - This bill establishes the Criminal Justice Enhancement Account and further provides for fines.  Sen. mellow offered A2324 that further defines the crime of burglary.  The amendment was agreed to unanimously.  The bill was reported out 22-3.

HB 369 - This bill adds certified hazardous material response team members to the Emergency Law Enforcement Personnel Death Benefits Act.  The bill was reported unanimously.

HB 496 - This bill raises the fees charged to nuclear power facilities for operating in Pennsylvania.  The bill also establishes new fees for the disposal of their radioactive wastes. The bill was reported unanimously.

HB 1367 - This legislation extends the sunset date on the nursing home provider assessment, confirms the rate cap authorized by the General Assembly via Act 42 of 2005 and the appropriations process, and continues the state’s ability to effectively moderate the growth of nursing home beds.  Finally, this legislation creates the Senior Care and Services Study Commission.  The bill was reported from committee 26-0.

HB 1287 - This bill makes appropriations to the Pennsylvania Gaming Control Board, and the Attorney General, the Department of Revenue, and the Pennsylvania State Police for their duties in regards to the gaming law.  The bill was reported out 26-0.

HB 1295 - This bill amends the Keystone Recreation, Park and Conservation Fund Act (Act 50 of 1993) by transferring revenues in the fund to the State System of Higher Education for Fiscal Year 2006-2007.  Sen. Appropriations Committee 06/25/07

The Senate Appropriations Committee met on Monday, June 25, 2007 and reported out the following bills:

SB 97 - This bill changes the calculation of book value which is the basis for the bank shares tax.  The new basis would be total equity capital.  Beginning in January of 2008 banks would be allowed to subtract from total equity capital goodwill created when banks merged or acquired one another.  The bank shares tax was never designed to include such goodwill but a federal accounting standards board (FASBE) ruling required this created goodwill to be included in a banks book value, which in turn required banks to include it as Pennsylvania taxable income.  Sen. Armstrong offered A2104 that is a technical date change.  The bill and amendment were reported 25-0.

SB 468 - This bill amends the state Constitution to prohibit a sine die session.  The bill was reported 20-4.

SB 638 - This measure establishes the Cancer Drug Repository Program for accepting donated cancer drugs and providing the responsibilities of the State Board of Pharmacy and the Department.  Sen. Armstrong offered A2104 that removes an unnecessary definition.  The amendment and bill were reported 25-0.

SB 763 - The bill would effectively preempt a tax being levied in two small university towns.  Millersburg and Edinburgh have created a tax on lease transactions primarily by students renting apartments within the municipalities.  Apartment owners in the two towns took the issue to court and the Commonwealth court ruled that such a tax was not prohibited by the provisions of Act 511.  This bill would prohibit that tax.  Sen. Browne offered A2101 that grandfathers municipalities that have the tax in place by July 1, 2007. The amendment and bill were reported 25-0.

SB 857This bill would amend the Second Class County Port Authority Act to provide for additional oversight and additional appointments to the Board.  Sen. Armstrong offered A2087 that would keep the board at nine members and the reports be delivered to the chair and vice chair of the Senate and House Transportation committees instead of the leaders of the four caucuses.  The amendment was agreed to unanimously.  Sen. Logan motioned to table the bill, that motion was defeated 9-16.  The bill was reported from committee 16-9.

SB 968This bill amends Act 13 of 202 known as the Medical Care Availability and Reduction of Error Act (Mcare) by adding a new chapter that relates to the reduction and prevention of health care-associated infections.  Sen. Armstrong offered A2012 that amends the bill regarding infection control plans, annual assessments to nursing homes, reporting requirements and costs of screening.  The amendment and bill were reported unanimously.

HB 842 - This legislation would amend the Public School Code to require that the Department of Education may only place a teacher’s certificate in inactive status between June 30 and July 31 for noncompliance with continuing education requirements.  Sen. Rhoades offered A2190 that implements provisions for distributing school funding.  The amendment and bill were reported 17-9 along party lines with Democrats voted in the negative.

SB 728 - This bill amends the Fiscal Code to provide that all of the money deposited in the Keystone Recreation, Park and Conservation Fund (Keystone Fund) in 2006-07 be transferred to the PA State System of Higher Education.  Sen. Armstrong offered 2204 that provides for implementation of the budget.  The amendment and bill were reported unanimously.

SB 913 - This bill requires the Department of Environmental Protection to compile a report detailing all the fines received by the various funds and to transfer any surplus fines received to the hazardous sites clean-up fund.  Sen. White offered A2086 that transfers $40 million to the Hazardous Sites Cleanup Fund.  The amendment and bill were reported out 16-10 along party lines with Democrats voting in the negative.



 

Appropriations Committee 06/20/07

The Senate Appropriations Committee met on Wednesday, June 20, 2007 and reported out the following bills:

SB 811 - This bill establishes the Long Term Living Facility Licensure Information Act.  The Department of Aging is required to maintain a listing on its publicly accessible Internet website for each type of facility which must be updated monthly.

SB 961 - This bill limits, for third class cities with a population of between 22,500 and 23,000 citizens, the amount of special earned income tax (EIT) that can be levied to pay for a deficient municipal pension system.  Currently any municipality can levy an EIT under special municipal taxing powers contained in the Municipal Pension Plan Funding Standard and Recovery Act.  The municipality is required to use all the additional revenue to pay down the unfunded liability in their pension systems.  This bill attempts to cap that taxing power at 0.5%. 

SB 968 - This bill amends the Medical Care Availability and Reduction of Error (Mcare) Act by adding a new chapter that relates to the reduction and prevention of health care-associated infections.  Sen. Armstrong offered A1720 that makes changes regarding regulatory language, confidentiality provisions, advisory committee representation and payments for cost of screening.

Appropriations Committee 06/19/07

The Senate Appropriations Committee met on Tuesday, June 19, 2007 and reported out the following bills:

SB 913The bill requires DEP to provide a list of each fine, fee, penalty and natural resource damage award received in any of the following funds:  Clean Air Fund, Clean Water Fund, Solid Waste Abatement Fund, Safe Drinking Water Fund and the Waste Transportation Safety Account.  The bill also requires a listing of each individual fine, fee or penalty over $10,000 and the nature of the violation that led to the collection of that fine.  The bill also requires that if the total amount of fines or fees of any of the above listed funds is 5% higher than in the previous year the amount in excess of 5% is to be transferred to the Hazardous Sites Clean-up Fund (HSCA).   The bill was reported 25-1.

HB 1286 - The bill would be the Commonwealth’s annual general appropriations act for the 2007/08 fiscal year, if enacted.  The proposed spending plan would reduce the Governor’s proposed General Fund budget by nearly $260 million.  All Special Fund appropriations are funded at the levels requested by the Governor.  Sen. Armstrong offered A1709 that will represent a 2.7% increase in last year’s budget.  The amendment and bill were reported 26-0.


 

Appropriations Committee 06/18/07

The Senate Appropriations Committee met on Monday, June 18, 2007 and reported out the following bills:

SB 399This bill amends the Public School Code by adding programs that relate to accountability block grants.  Through this legislation, school districts will be allowed to use their grant money for additional programs if they chose to do so. 

SB 455 - This bill amends the Dental Law providing for the definitions of “dental hygienist”, “board” and “independent dental hygiene practitioner”; for the Dentistry powers and radiologic procedures, education, training and independent practice.  The bill essentially provides for the certification of “independent dental hygiene practitioners” who could perform dental hygiene services without the supervision of a licensed dentist in certain facilities.  Sen. Armstrong offered A1613 which was technical.

SB 728 - This bill amends the Fiscal Code to provide that all of the money deposited in the Keystone Recreation, Park and Conservation Fund (Keystone Fund) in 2006-07 be transferred to the PA State System of Higher Education.

SB 752 - This act further defines the term, “acceptable data”.  This term shall be defined as, “empirical, replicable and testable data as evidenced in supporting documentation, statistics, reports, studies, or research.  The agency advocating that any data is acceptable shall have the burden of proving that the data is acceptable.

SB 846The bill contains supplemental appropriations for the current fiscal year, as requested by the Governor.   It adds a total of $211,568,000 in new state spending.  Sen. Armstrong offered A1627 that would reduce the appropriations by $32 million.

SB 1286 - The bill would be the Commonwealth’s annual general appropriations act for the 2007/08 fiscal year if enacted.  Sen. Armstrong offered A1462 that makes reductions in the budget totaling $328,857,000.  The amendment was reported mostly along party lines, 17-9 with Democrats voting in the negative.  The bill was reported by the same 17-9 vote.


 

Appropriations Committee 06/12/07

The Senate Appropriations Committee met on Tuesday, June 12, 2007 and reported out the following bills:

SB 929-948 and SB 950-959 - These bills would appropriate $785.2 million to those non-state owned institutions known as “non-preferreds.” Sens. Wozniak Boscola and Gordner expressed their wishes to be voted in the negative with regards to the bills funding museums (SB 953-959) and for bills that fund trade schools (SB 940-042).  Sen. Wozniak also voted in the negative for SB 934.  The remainder of the bills were reported unanimously.

HB 906 - The authority of PEMA to award grants through the Volunteer Fire Company and the Volunteer Ambulance Service grant program has expired.  This legislation will provide for a grant cycle for state fiscal year 2006-07 and 2007-08.  It will make it a one time only grant program of $50 million.  The fiscal period will begin July 1, 2006 and end June 30, 2008.  The intent of this legislation is to circumvent any potential for confusion that could occur for fire companies, ambulance services and PEMA in the event of over-lapping the end of one grant cycle with the beginning of a new grant cycle.  After the time cited in this legislation the grant periods will return to one year time slots (12 months).  Sen. Waugh offered A1445 that allows grantees to receive one grant for each fiscal year.  The amendment and bill were reported 26-0.

The Senate Appropriations Committee met on Monday, June 11, 2007 and reported out the following bills:

SB 246 - This bill establishes the Clean Indoor Air Act.  The bill was reported unanimously 26-0.

SB 612 - This bill gives the authority to the Landscape Architects Board that they can license someone from another state without them taking the written exam.  However, their qualifications from the state that they are coming from must have qualifications equal to Pennsylvania’s.  The bill was reported out 25-1.

SB 737This bill amends Title 18 by repealing the sunset date of Act 141 of 2002, which permits certain underage individuals to assist in compliance checks.  The bill was reported unanimously 26-0.

SB 834This legislation expands The Advisory Council on Library Development from 12 members to 14 members.  The bill was reported unanimously 26-0.

SB 877This bill amends the Public Welfare Code adding several definitions and by requiring the Department of Public Welfare (DPW) to provide a program of Mandatory managed care for physical health care services in the following areas:  the southeast, southwest, Lehigh and Capital areas.  The bill was reported unanimously 26-0.

HB 876 - This bill maintains a minimum 4% contribution rate for the commonwealth to the state employee’s retirement system (SERS) for fiscal year 2007-08 and each year thereafter.  The bill was reported unanimously 26-0.

SB 385 - This legislation would require VoIP telephone service providers to assess a $1 fee for each customer service line. SB 413 - This bill exempts signs and billboards from property tax even if they are affixed to the real property for Second Class and Second Class A Counties.  The bill was reported with a 25-1 vote.

SB 799 - This bill will add an additional statewide organization to the list of organizations that the governor may choose a Board member to the Center for Rural Pennsylvania. The bill was reported 26-0.

SB 87 - This bill amends Title 62 (Procurement) requiring the Department of General Services to establish a policy for state agencies that use the Department of General Services for procurement purposes. This bill requires each purchasing agency to have an annual goal of not less than 5% participation by veteran-owned businesses in all contracts entered into by the purchasing agency.

SB 691 - This measure will provide that in order for a veteran to receive a veteran placard they must have a service related disability of 75% rather than 100%.

SB 782 - This bill raises the fees charged to nuclear power facilities for operating in Pennsylvania.  The bill also establishes new fees for the disposal of their radioactive wastes.

SB 795 - This bill appropriates $51.48 million to the Public Utility Commission for  operation during the 2007-08 state fiscal year.

SB 815 - This bill extends the sunset date for both the underground storage tank cleanup program and the underground storage tank pollution prevention program until June 30, 2012.

SB 794 - This bill will make appropriations from the Workmen’s Compensation Fund to the Department of Labor and Industry and the Department of Community and Economic Development.

SB 796 - This bill makes an appropriation from the restricted account in the General Fund for the operation of the Office of Consumer Advocate.

SB 797 - This bill would appropriate funds through the Department of Community and Economic Development for the Small Business Advocate for the 2007-08 fiscal year.

SB 798 - This bill provides for the Capital Budget Act of 2007-2008.  Sen. Armstrong offered A0562 that  allows the Dept. of General Services to award claims in certain construction projects.

Appropriations Committee 04/24/07

The Senate Appropriations Committee met on Tuesday, April 24, 2007 and reported out the following bills:

SB 318 - This bill makes a number of technical changes such as changing the term used when identifying the Pa. State Police.  It defines that members of the Pa. State Police assigned to the Delaware River Toll Bridge Commission, Gaming Enforcement and Liquor Control Enforcement shall not be used for counting purposes.  The number of enlisted men, and officers shall not exceed 4,310.

SB 650 -  This legislation amends the liquor code by adding to the list of entities that are permitted to use a special occasion permit for more than six consecutive or non-consecutive days.  Instead, these entities are allowed to use the permit for ten consecutive or six non-consecutive days.  This bill adds “a bona fide sportsmen’s club in existence for at least ten years conducting a national golf championship.”

Both bills were reported from committee 26-0.


 

Appropriations Committee 04/16/07

The Senate Appropriations Committee met on Monday, April 16, 2007 and reported out the following bills:

SB 72 - This bill  provides that volunteer licensees who are physicians complete a minimum of 20 credit hours of American Medical Association Physician’s Recognition Award Category 2 activities during the preceding biennial period as a condition of biennial renewal and would be exempt from any continuing education requirement imposed by section 910 of the Medical Care Availability and Reduction of Error Act or by board rulemaking. 

SB 112 - The legislation would amend the Public School Code by clarifying and adding additional requirements for school entities in the reporting of incidents of violence on school property.

SB 365 - This bill extends the sunset date for the Senior Judge Operational Support Grants from June 30, 2007 until June 30, 2012.

Appropriations Committee 03/26/07

The Senate Appropriations Committee met on Monday, March 26, 2007 and reported out the following bills:

SB 73 - The legislation provides for the codification of various statutes relating to the confinement of county and state criminal offenders as well as the supervision of such offenders on probation or parole. 

SB 180 - The legislation adds the National Cemetery of the Alleghenies to the department’s power for arrangement of veterans’ burial details

SB 355 - The bill modernizes the advertising process of changes to the SIP plan to include the use of the internet.  Whichever department or agency of state government that is responsible for the proposed changes would be required to make the changes available on their publicly accessible web site.  The existing requirements to publish proposed changes in newspapers are left unchanged.  Sen. Armstrong offered A0251 that is a technical amendment.

SB 548 - The Long-Term Care Partnership Program is established under the measure.  The Department of Public Welfare will administer the program.   The bill specifies that the purpose of creating a Long-Term Care Partnership Program is to reduce future Medicaid costs for long-term care by delaying or eliminating dependence on Medicaid by providing incentives for people to purchase long-term care insurance.

SB 550 - The bill amends the Insurance Company Law of 1921 to further provide for the regulation of Blue Cross and Blue Shield consolidations under the Insurance Holding Company Act.  The consolidation of any Blue Cross/Blue Shield parent company would now fall under the oversight and review requirements of the Insurance Department.

Appropriations Committee 03/19/07

The Senate Appropriations Committee met on Monday, March 19, 2007 and reported out the following bills:

SB 150 - This legislation would enact the Sexual Violence Protection Act relating to the protection of victims of sexual violence by allowing them to petition the court for protection from the defendant.  Sen. Greenleaf offered A0072 that inserts the recommendations by the State Victim Advocate.  The bill and amendment were reported 26-0.

SB 263 - This bill would increase payments to claimants under the Pennsylvania Occupational Disease Act by $25 to $150 per month.  The bill was reported 26-0.

SB 356 - The bill creates the Pennsylvania Center for Environmental Education to coordinate the materials and curriculum for primary environmental education within the Commonwealth.  Sen. Armstrong offered A0160 which is technical.  The bill and amendment were reported 26-0. 

SB 397 - The bill amends the Judicial Code by adding a new section, 1725.5, which establishes guidelines and authorization for the collection of central or regional booking fees.  The bill was reported 25-1 with Sen. Wozniak voting against.


 

Appropriations Committee 02/12/07

The Senate Appropriations Committee met on Monday, February 12, 2007 and reported out the following bills:

SB 71   - The bill would amend the Public School Code to require schools for the 2007-2008 school year to adopt a policy related to bullying or to include such policy as part of its existing Code of Student Conduct.  The bill was reported 25-1.

The remainder of the bills were reported 26-0.

SB 154 - This bill would amend the Public School Code to require that certain school districts revise their professional education plans and require the Department of Education to create a clearinghouse of continuing professional education programs.

SB 155 - The legislation would add a section to the Public School Code providing that each intermediate unit may establish and coordinate a pool of educational advisors to provide assistance to any school district or school assigned to the intermediate unit and identified for school improvement or corrective action. 

SB 157 - This legislation amends the Public School Code to direct intermediate units to coordinate academic improvement programs for school districts and to establish academic improvement teams to assist school districts.

SB 158 - This bill would amend the school code to provide for establishing parent involvement programs and policies in school districts.

SB 219 - The bill would amend the Public School Code to add certified registered nurse practitioners and physicians’ assistants to the list of professionals who can perform the physical tests needed by teachers in order to get their certification.  The bill would also require the Department of Education to prescribe a method of submitting a set of fingerprints for new applicants to the FBI, in accordance with federal law.


 

Appropriations Committee 02/05/07

The Senate Appropriations Committee met on Monday, February 5, 2007 and reported out the following bills:

SB 10 - This measure will establish a procedure by which volunteer fire companies and volunteer ambulance companies shall submit grants pursuant to the Volunteer Fire Company and Volunteer Ambulance Service Grant Act.

SB 218  - This bill amends the Local Tax Enabling Act to reform the imposition, collection and administration of the $52 Emergency and Municipal Services Tax.   Sen. Logan offered A0022 that deletes references to Pittsburgh and allows the city to collect the tax quarterly.
