The Senate Rules and Executive Nominations Committee met 10-8-08 and reported out the following:

SB 100             This bill shall be known as the Home Improvement Consumer Protection Act.  The bill was reported 13-0.

 

SB 263             This bill would increase payments to claimants under the Pennsylvania Occupational Disease Act by $50 to $175 per month.  The bill was reported 13-0.

 

SB 295             This bill creates a free standing Act to be cited as the Diesel-Powered Motor Vehicle Idling Act.  The bill was reported 13-0.

 

SB 763             This bill amends the Local Tax Enabling Act to further provide for the delegation of taxing power and restrictions. The bill was reported 13-0.

 

SB 768             This legislation amends Title 64 (Public Authorities and Quasi-Public Corporations) to allow institutions that do not offer deposit services to qualify as providers of commercial lending.  The bill was reported 13-0.

SB 1107            The legislation amends Title 51 (Military Code) to further provide for child custody agreements of deployed military service personnel.  The bill was reported 13-0.

 

SB 1258            This bill amends the Fourth to Eighth Class and Selective County Assessment Law further providing for appeals by municipalities in selected counties.  The bill was reported 13-0.

SB 1504            Senate Bill 1504 provides for the Highway Capital Budget Itemization Act of 2008-2009.  The bill was reported 13-0.

SB 1028            The bill amends the Second Class Township Code (Act of May 1, 1933, P.L.103, No.69) by clarifying when a road is to be declared public by providing for the types of evidence that may used to demonstrate its public purpose.  The bill was reported 13-0.

 


Rules and Executive Nominations Committee 10/07/08

The Senate Rules and Executive Nominations Committee met 10-7-08 and reported out the following:

SB 684             The legislation creates the Public Health Child Death Review Act in which State and local review teams will examine the circumstances surrounding deaths of children in Pennsylvania.  The purpose of the program is to promote safety and reduce child fatalities. 

 

SB 1114            This bill designates roads in Fayette County, Erie County and the City of Philadelphia.  An amendment was offered A9756 that includes additional bridge naming.

 

SB 1225            The bill creates a system of Intrastate Mutual Aid between participating political subdivisions within Pennsylvania.  The system will provide for mutual assistance among the subdivisions in the prevention of, response to and recovery from threats to public health and safety that are beyond the capability of an affected community to respond. 

SB 1503            This measure provides for the Highway – Railroad and Highway Bridge Capital Budget Itemization Act of 2008-2009 (Bridge Bill).

 

HB 1096            The bill amends the Pennsylvania Construction Code Act by establishing The Uniform Construction Code Review and Advisory Committee.  Sen. Pileggi offered A9677 that was technical. 

 

SB 740             The bill authorizes the Department of General Services to grant and convey certain tracts of land in Centre County.  Four amendments were offered, A9973, A9765, A9767, and A9778 that all add land conveyances.

SB 1308            This legislation authorizes a land conveyance in Solebury Township, Bucks County and in Philadelphia.

The Senate Rules and Executive Nominations Committee met 9-17-08 and reported out the following:

SB 180             The legislation amends Title 51 by adding the National Cemetery of the Alleghenies to the department’s power for arrangement of veterans’ burial details as well as providing dental or vision services to full-time students of the Pennsylvania National Guard or Reserve components of the Armed Forces called or ordered to active duty.  The bill was reported unanimously.


 

Rules and Executive Nominations Committee 09/16/08

The Senate Rules and Executive Nominations Committee met 9-16-08 and reported out the following:

HB 4     This bill amends Title 42 and Title 44 to further provide for the sentencing, re-sentencing, incarceration, probation and parole of certain offenders in the Commonwealth.  Sen. Pileggi offered an agreed to amendment that changed dates in the bill.  The amendment was adopted and the bill was reported from committee 12-2.

The Senate Rules and Executive Nominations Committee met Friday, July 4, 2008 and reported out the following:

SB 2 - This bill provides for the allocation of money in the Pennsylvania Gaming Economic Development and Tourism Fund for funding water infrastructure and high hazard dam projects.  The bill is known as the H2O PA Act.  The bill was reported unanimously.

SB 385 - This bill would provide for Voice over Internet Protocol (VoIP) telephone service and establish the VoIP Emergency Services Fund.  The bill was reported unanimously.

SB 763 - This bill amends the Local Tax Enabling Act to further provide for the delegation of taxing power and restrictions.  The bill was reported unanimously.

SB 844 - This bill amends the Real Estate Licensing and Registration Act to further provide for prohibited acts and for the handling of deposits and other escrows.  The bill was reported unanimously.

SB 1332 - The bill amends Title 53 (Municipalities) by adding a uniform oath of office for elected and appointed municipal officials.  The bill was reported unanimously.

SB 1341 - This bill, known as the “Water and Sewer Systems Assistance Act”, authorizes a bond referendum of $400 million for improvements to drinking water and wastewater treatment systems.  If approved by the voters, the bond money would be administered through the Pennsylvania Infrastructure Investment Authority (PennVest).   The bill was reported unanimously.

SSSB 22 - This bill amends the Alternative Fuels Incentive Act (Act 178 of 2004) to increase the reimbursement for the production of renewable fuels, provides funding for education and provides for biodiesel production incentives.  The bill was reported unanimously.

The Senate Rules and Executive Nominations Committee met Thursday, July 3, 2008 and reported out the following:

SB 356 - This bill amends the “Environmental Education Act” (Act 24 of 1993) to establish the Pennsylvania Center for Environmental Education.   The bill was reported 17-0.

SB 838 - This bill amends the CPA Law further providing for definitions, for the State Board of Accountancy, for administrative powers, fees, and licensing and peer review.  The bill was reported 17-0.

SB 1297 - This bill amends the Fiscal Code to extend the authorization for the State Treasurer to use the prudent person rule to make investments, for audits of securities deposited with the State Treasurer, and for appeals to Commonwealth Court for persons aggrieved by decisions of the State Treasurer.  Sen. Pileggi offered A8780 that provided for budgetary language.  The amendment and bill were reported 17-0.

SB 1348 - This bill makes an appropriation of $52.162 million from the Restricted Revenue Account within the General Fund for the operation and administration of the Pennsylvania Public Utility Commission and its Commissioners.  Sen. Pileggi offered A8761 that removes the appropriation for education programs.  The amendment and bill were reported 17-0.

SB 1424 - This bill amends the Board of Vehicles Act to further provide for licensing cost.  The bill was reported 17-0.

HB 1589 - This bill provides for the Capital Budget Project Itemization Act of 2007-2008.  The bill was reported 17-0.   

SB 1412 - This bill amends the Keystone Opportunity Zone, Keystone Opportunity Expansion Zone and Keystone Improvement Zone Act providing for extensions, substitution of parcels outside a subzone, and for sales and use tax and corporate income tax.  The bill was reported 17-0.


 

Rules and Executive Nominations Committee 07/02/08

The Senate Rules and Executive Nominations Committee met Wednesday, July 2, 2008 and reported out the following:

SB 1000 - This bill would prohibit the regulation of voice over Internet protocol (IP) as well as provide for consumer protection, fees and rates, and preservation of cable franchise authority.  The bill was reported 16-0.

 

SB 1389 - This bill  was to provide supplemental appropriations for 2007-08 fiscal year.  It now contains the general appropriation act.  The bill was reported 16-0.

 

SR 352 - The resolution commemorates the contributions of Milton Friedman and the 96th birthday of Milton Friedman on July 31, 2008.  The bill was reported 16-0.

HB 1150 - This legislation mandates insurance coverage for autism spectrum disorders and colon cancer screenings; outlines statutory requirements for the Blues Merger; raises the admitted assets investment cap and makes changes for shareholders of domestic insurers.  The bill was reported 16-0.


 

Rules and Executive Nominations Committee 06/29/08

The Senate Rules and Executive Nominations Committee met Sunday, June 29, 2008 and reported out the following:

SB 483 - Amends the Usury Law to limit pre-payment penalties, increases the fine for violations of the law, clarifies and
expands the investigation and enforcement duties of the Banking Department.  The bill was reported unanimously.

 

SB 484 -Amends the confidentiality provisions of the Banking Code to authorize the Department of Banking to publicly
release information about enforcement actions, and provides for the use of a electronic licensing system and criminal
history record checks for all licensees.  The bill was reported unanimously.

SB 485 - This bill amends the Real Estate Appraisers Certification Act to expand the Certified Real Estate Appraisers
Board and further provide for Certified Real Estate Appraisers as well as disciplinary measures.  The bill was reported
unanimously.

SB 949 - This bill creates the “Bituminous Coal Mine Safety Act” and is an extensive revision of Pennsylvania’s
underground mine safety law.  The bill applies to all underground bituminous coal mines in Pennsylvania.  Sen. Kasunic
offered A8256 that restores language that was removed from the bill that will increase safety standards.  The amendment
and bill were reported unanimously.

SB 999 - This bill designates a portion of State Route 26 in Centre County and also designates the bridge on State Route
322 joining Clearfield and Centre Counties.  Sen. Pileggi offered A8199 that names highways in Centre and Perry counties. 
The amendment and bill were reported unanimously.

The Senate Rules and Executive Nominations Committee met Friday, June 27, 2008 and reported out the following:

SB 1063 - This bills reforms the local income tax collection system.  The bill was reported 14-2.

SB 1147 - This legislation amends Title 23, (Domestic Relations) to further provide for definitions, immunity from certain
liability, release of information in confidential reports, for studies of data, for creation of child advocacy centers, and fatality
or near fatality review teams, for investigating county child welfare agency performance with reporting requirements related
to the area of child protective services.  The bill was reported 16-0.


 

Rules and Executive Nominations Committee 06/17/08

The Senate Rules and Executive Nominations Committee met 6-17-08 and reported out the following:

SB 949 - This bill creates the “Bituminous Coal Mine Safety Act” and is an extensive revision of Pennsylvania’s
underground mine safety law.  The bill applies to all underground bituminous coal mines in Pennsylvania.  Sen. Madigan
offered A7142 that removes language that the House placed in the bill.  The House language added more additional safety
standards such as an worker walking around inspector, dual shaft distance and a shorter transport system.  The
amendment and bill were reported out 12-5 with Democrats voting against the amendment and bill and siding with the more
stringent standards placed in the bill by the House.

The Senate Rules and Executive Nominations Committee met 4-9-08 and reported out the following:

SB 638 - The State Board of Pharmacy shall establish a Cancer Drug Repository Program consistent with public health
and safety standards through which unused cancer drugs may be redispensed to cancer patients.  The bill was reported
14-0.

SB 810 - This bill authorizes a land conveyance in the City of Pittston, Luzerne County and in Bensalen Township, Bucks
County.  Sen. Musto offered A5666 that removes the land conveyance in Bucks County from the bill.  The amendment and
bill were reported 14-0

SR 264 - The resolution recognizes May 1, 2008, as the “National Day of Prayer” in Pennsylvania. 

SR 285 - This resolution provides for a temporary rule of the Senate, which would rule out of order certain amendments
to General Appropriation Bills for the fiscal year 2008-09.

records, legislative records and financial records to be publicly accessible, unless certain conditions apply. It defines terms,
provides exceptions to public access, establishes the Pennsylvania Public Records Office in the State Ethics Commissions
provides procedures for requesting access to records and establishing fees, provides penalties and establishes the effective
date.  This version of the bill was amended by the House to reflect compromise language.  The bill passed the House and
upon Senate approval will be sent to the Governor.  The bill was reported from committee 15-0.

SB 246 - This bill would prohibit smoking in certain public places and workplaces.  The bill was reported 17-0.

SB 466 - This bill would amend the Pennsylvania Construction Code Act to exempt temporary structures and pole barns at agricultural fairs.  The bill was reported 17-0.

SB 548 - The Long-Term Care Partnership Program is established under the measure.  The Department of Public Welfare will administer the program.  The bill was reported unanimously, 17-0.

HB 1295 - This bill amends the Fiscal Code to provide that all of the money deposited in the Keystone Recreation, Park and Conservation Fund (Keystone Fund) in 2006-07 be transferred to the State System of Higher Education. The bill also provides for the budget implementation language and The Commonwealth Group Life Insurance Plan.  The bill was reported 17-0.

SB 413 - This legislation will prohibit counties of the second class from assessing signs or sign structures for the purposes of real estate taxes.  The bill was reported 17-0.

Pileggi offered A3098 that implements budget language and extends sunset dates for senior judges.  The amendment and bill were reported 16-0.

SB 968 - This bill amends the Medical Care Availability and Reduction of Error (Mcare) Act by adding a chapter that relates to the reduction and prevention of healthcare-associated infections.  The bill was reported 16-0.

SB 623 - The bill amends the Crimes Code to clarify the powers of corrections officer and to provide authorization for the use of force for such persons, and to provide a definition of firearm for theft prosecutions and for tracing and recording illegal guns.  Sen. Robbins offered A3110 that removes the registry of firearms language.  The amendment and bill were reported 15-1.

HB 906 - The legislation amends the Volunteer Fire Company and Volunteer Ambulance Service Grant Act.  It further defines volunteer fire company, minimum and maximum amounts of grants, regulations for the agency about posting of the grants, qualifications of eligibility and publication of notice of grant availability.  This bill will also extend the sunset date to June 30, 2012.  The bill was reported out 15-0.
