Labor and Industry Committee 12/15/09

The Senate Labor and Industry Committee met on Tuesday, December 15, 2009, and unanimously reported out the following bill as amended:

SB 1077 - This bill expands the provisions of the Construction Code to be applicable to buildings with log walls without insulation when the log walls have a minimum average wall thickness of five inches or greater.  The bill was amended so it complies with the International Code Council Standards on the design and construction of log structures.


 

Labor and Industry Committee 09/24/09

The Senate Labor and Industry Committee met on Thursday, September 24, 2009, and unanimously reported out the following bill as amended:

HB 1614:  The bill amends the Fiscal Code of 1929 and Banking Code of 1965 by giving the power of the State Workers’ Insurance Board to increase the investment of assets from the State Workers’ Insurance Fund in equities. It also changes the date in which these terms will expire to June 30, 2014.   Amendment A03873 was offered which changes the sunset date from June 30, 2014 to 2010.


 

Labor and Industry Committee 07/27/09

The Senate Labor and Industry Committee met on Monday, July 27, 2009, and unanimously reported out the following bill as amended:

 

HB 1770 - The bill amends the Unemployment Compensation Law by adding a temporary triggering mechanism that would provide the state’s current unemployment compensation an additional seven weeks of extended benefits for eligible individuals.  Amendment A03123 was offered which makes the act apply retroactively to July 1, 2009.


 

Labor and Industry Committee 06/23/09

The Senate Labor and Industry Committee met on Tuesday, June 23, 2009, and unanimously reported out the following bills as amended:

 

SB 369 - The bill amends the Emergency and Law Enforcement Personnel Death Benefits Act by adding a paid firefighter, ambulance service member, rescue squad member or law enforcement officer to those individuals who surviving spouse, minor children or surviving parents receive $100,000 as well as the monthly salary of the individual once the Commonwealth receives a death certificate.  Senator Tartaglione offered amendment A01948 which changes it so that the bill takes effect immediately. 

 

SB 563 - This bill would amend the Mechanics’ Lien Law of 1963 to make a change to the residential construction exclusion, to prohibit a lien in excess of the unpaid balance of the contract price, and to require that a lien be subordinate to certain mortgages. Amendment A01266 was offered which would gut the bill and make it so that the legislation would eliminate the $1 million maximum for the residential exclusion and replace it with language that defines a “residential property” as “not more than three stories in height, not including any basement level, regardless of whether any portion of that basement is at grade level.”

 

SB 821 - The legislation amends the Public School Code by requiring that each school district have and maintain a certified safety committee by December 10, 2010. Amendment A01977 was offered which states that the Act does not apply to any district that cannot receive a premium discount or an equivalent reduction in contribution rates, by establishing and maintaining a certified safety committee because it is authorized to self-insure or pool its liabilities as well as changes the effect date to immediately. 

 

SR 62 - The resolution urges the spending of the Federal economic recovery funds on products that are made and services that are performed in the United States.  Amendment A01955 was offered which was technical in nature. 

The committee reported out the following bill as amended:

SB 951 - The bill amends the Pennsylvania Prevailing Wage Act by listing the penalties for any person or firm who intentionally fails to pay the prevailing wage. Amendment A01951 was offered which changes what the secretary can collect as a penalty from double the amount of underpayment to five times the amount

 

The Senate Democrats were opposed to the bill as amended because they feel that contractors are getting away with underpayment and not getting caught every time, therefore a monetary penalty is not severe enough.  Senator Kasunic requested that the committee go over the bill, however that motion was struck down by a vote of 6-4, split between party lines.  A vote on the bill as amended was 6-4.


 

Labor and Industry Committee 03/17/09

The Senate Labor and Industry Committee met on Tuesday, March 17, 2009, and unanimously reported out the following bill as committed:

 

SB 195:  The bill amends the Industrialized Housing Act by further defining “industrialized/commercial modular building” and “industrialized/commercial building module.”

The following bill was unanimously reported out as amended:

SB 174:  The legislation amends the Workforce Development Act by establishing the Pennsylvania Center for Health Careers within the Department of Labor and Industry which will develop strategies to address the State’s short-term and long-term health care work force challenges.  Amendment A00308 was offered which takes away powers and duties from the center.
