This bill amends Title 4 (Amusements) and Title 18
(Crimes and Offenses) as they relate to the new gaming
law by further providing for a new definition of
“supplier”, for the review of deeds, leases, and
contracts; for the further disclosure of all public
official financial interests; for local land use
preemption; and for greater latitude on the part of the
Attorney General to investigate and prosecute
violations. A 28-19 vote was recorded on concurrence on
House amendments.

This
bill amends the Local Tax Enabling Act further providing
for the appointment of a single collector of taxes and
establishes the emergency and municipal services tax.
Senator Orrie offered amendment A5564, which creates a
.55% payroll tax expense in Pittsburgh. The amendment
was adopted with a 30-17 vote. Senator Wagner offered
amendment A5550 and amendment A5551. Amendment A5550
would eliminate the business privilege tax, increase the
payroll tax expense proposed in Orrie’s amendment from
.55% to .855%, decrease the parking tax in Pittsburgh by
20%, and eliminate the non-profit arts tax. The
amendment was defeated with a 16-31 vote. Amendment
A5551 would keep the payroll tax expense in Orrie’s
amendment the same, reduces business privilege tax to 2%
and eliminates exemptions, reduces the parking tax by
30%, and eliminates the non-profit arts tax. The
amendment was defeated with a 16-31 vote. Senator
Rhoades and Senator Mellow offered amendment A5413,
which eliminated the ability to charge an admission fee
for bowling alleys. The amendment was adopted with a
46-1 vote. The bill went over as amended.

This bill amends the Borough Code to permit the use of a
portion of the dedicated tax to support fire protection,
ambulance service, rescue squads and other emergency
services. A 47-0 vote was recorded.

This bill amends the 2nd Class Township Code
to permit the use of a portion of the dedicated fire tax
to support fire protection, ambulance service, rescue
squads and other emergency services. A 47-0 vote was
recorded.

The bill amends the Judicial Code to limit liability for
damages from donated vehicles or equipment to volunteer
fire companies, and a new section was added relating to
sentences for certain drug offenses committed with

offense of Careless Driving. Senator Fumo offered
amendment A4984, opens easements for small landlocked
farms. The amendment was adopted 47-0. Senator C.
Williams offered amendment A5499, which provides
immunity for towing damaged property and provides
payment to towers. The amendment was adopted 47-0. The
bill went over as amended.

This bill amends several sections of Title 75, Vehicle
Code, dealing with the reconstructed vehicle inspection
program. A 47-0 vote was recorded.
HB 2442, PN 4806 This bill amends the Regulatory Review Act, further providing for legislative intent, for definitions and
for proposed regulations and procedure for review. Senator Brightbill offered amendment A5494, which eliminates the legislative
intent and also state agencies would no longer have to prepare an impact study on regulations that effect small businesses.

HB 2664, PN 4810 This would create a chapter in Title 74 (Transportation) to deal with “Flying While Impaired.” Senator Madigan
offered amendment A5489, which provides up to $6 million for short rails. The amendment was adopted with a 47-0 vote.
Senator Kasunic offered amendment A5180, which places Fayette County back as a designated county. The amendment
was adopted with a 47-0 vote. Senator Stack offered amendment A5162, which provides a mandatory license suspension for
pilots who refuse a breathalyzer test. The amendment was adopted with a 47-0 vote. The bill went over as amended.

This
bill amends the Vehicle Code (Title 75) as it pertains
to inspection stickers and linkage to registration
renewal. Senator Madigan offered amendment A5379, which
allows employers of school bus drivers and commercial
drivers to obtain electronic copies of driving records
from PENNDOT. The amendment was adopted with a 47-0
vote. The bill went over as amended.

The
bill establishes a “Chesapeake Bay Watershed Education
Program” within the Department of Education. Senator
Hughes offered amendment A4987 for Senator Anthony
Williams, which adds environmental education center to
the definition of school. The amendment was adopted

HB 2105, PN 4801 The bill amends the Liquor Code by allowing the sale of wine or liquor-scented candles and the sale of
wine in containers at stores as well as allowing the board to use coupons. The legislation changes when state stores can be
opened and how many stores can be open for Sunday sales. The bill lowers the age that minors can work at a Continuing Care
Retirement Community. A point system for liquor license control is also established in this bill. The bill prohibits the use of
pyrotechnics in buildings. Also, wineries can sell wine by the glass if they sell that wine by the bottle under this bill. Finally,
the bill allows the board to issue a license to a distillery that had been established before January 1, 1875. Senator Rhoades
made a motion to table the bill, the motion failed with a 1-46 vote. A 41-6 vote was recorded on concurrence on House amendments.
