SB 1097, PN1567
:
The legislation designates State Route 6 in Wyoming County as a scenic byway.  The designated byway runs from the interchange with Business Route 6 on the west side of Tunkhannock Borough to the Business Route 6 interchange in Tunkhannock Township on the east side of the borough.

A2914(Lemmond): This amendment designates State Route 92 in Susquehanna County as a scenic byway.  The designated byway runs from Lenox Township through Jackson Township through the Borough of Susquehanna and continuing to the Borough of Oakland.  The amendment was agreed to. 

A2613(Kasunic): This amendment allows Fayette Area Coordinated Transportation (FACT) to again receive state funding assistance that it lost due to its classification change as a result of the 2000 Census.  The amendment was agreed to.

SB 1147, PN1673: The legislation provides for the display of the American flag or military flag by residents in a unit owners association, homeowners association or master association.  Under the legislation, a unit owners association, homeowners association or master association may not prohibit the outdoor display of the American flag or military flag by a homeowner on the homeowner’s property if the American flag is displayed in a manner consistent with federal law and a military flag is displayed in accordance with any reasonable rules and regulations adopted by the association. 

A2608(Greenleaf): This amendment prohibits a common interest community association from prohibiting a display of one American flag on property owned by a unit owner, but permits a prohibition against a display on a common area.  The amendment was agreed to.

A2782(Mellow): This amendment adds the Commonwealth flag and the POW?MIA flag to those already covered by the bill.  The amendment was agreed to.

SB 1158, PN1740: The legislation amends the Liquor Code to further provide for definitions, for general powers of the Liquor Control Board (LCB), for sales by Pennsylvania Liquor Stores, for malt and brewed beverages manufacturers’, distributors’ and importing distributors’ licenses, for renewal of licenses, for temporary provisions for licensees in armed service and for limited wineries. 

A2963(Conti): This amendment removes the provision allowing sales of candles acquired or produced by a limited winery from the bill.  The amendment was agreed to.

HB 1965, PN2564: The legislation repeals an outdated act which authorized the Pennsylvania Post-War Planning Commission to enter into agreements with political subdivisions in Pennsylvania for the financing of plans and specifications of public works and included an appropriation for its funding. The Post-War Planning Commission is a defunct agency that is no longer funded.  A 50-0 vote was recorded.

HB 2081, PN 3424: The legislation amends Title 51 (Military Affairs) by adding a section to allow a member of the Armed Forces, a full-time National Guard member, or a Civil Service technician with a National Guard unit to terminate a housing rental agreement in certain “non-active duty for war” situations.  A 50-0 vote was recorded.

HB 2105, PN4072: The legislation amends the Liquor Code to expand the definition of “public venue” to include a convention center with permanent seating or a convention center or trade show facility that has at least 60,000 square feet or more in one building.  The bill also allows the LCB to redeem coupons offered by a manufacturer or an agent of a manufacturer at the time of purchase.  Furthermore, a section is added to allow the LCB to issue a distillery of historical significance license to any distillery that was established prior to January 1, 1875. 

A2962(Conti): This amendment permits the LCB to sell wine or liquor-scented candles at state stores.  It also allows the holder of a limited winery license to sell wine or liquor-scented candles.  A 47-3 vote on the amendment was recorded.

HB 2268, PN3119: The legislation repeals provisions of two statutes (Act 28 of 1873 and Act 83 of 1874), which govern the use of the centennial exposition building, known as Memorial Hall, located in Fairmount Park, Philadelphia.  A 50-0 vote was recorded.

HB 2433, PN4246: The legislation amends the Volunteer Fire Company and Volunteer Ambulance Service Grant Act to provide for grants to be used to improve and enhance the capabilities of volunteer fire companies and ambulance services across the Commonwealth.  The grant programs would be administered by the Pennsylvania Emergency Management Agency.  A 50-0 vote was recorded.

The following amendment was agreed to the prior to final passage and included in the final language of the bill:

A2988(Logan): This amendment removes the language that designates the act a General Appropriations bill.

HB 2512, PN4229: The legislation amends the Milk Producers’ Security Act  to require new milk dealers that obtain licenses after the effective date of this act to file a bond with the Milk Marketing Board equal to a minimum of 75% of the highest aggregate amount owed by the milk dealer to all producers for a 40-day period during the preceding 12 months.  A new dealer would not be allowed to participate in the 30% bond/security fund option available under the current law.  A 50-0 vote was recorded.

HB1117, PN4144: The legislation amends the Crimes Code to provide for new offenses relating to railroad protection, railroad vandalism and interference with transportation facilities.  Under the bill, a person who causes damage to railroad property and knew or should have known that it was railroad property, or if he causes a delay in railroad operations commits a misdemeanor of the third degree. Further, a person commits a misdemeanor of the third degree if he rides on the outside of a train or inside a passenger car, locomotive or freight car, including a box car, flatbed or container without lawful authority or the railroad carrier’s consent. 

A2836(Mellow): This amendment adds a section to the bill amending Title 42 to provide for railroad civil immunity.  The amendment provides that a railroad carrier owes no duty of care to keep its railroad property safe for entry or use by trespassers or to give any warning for trespassers as to a dangerous condition on the property.  The amendment was agreed to.
