HB 1117, PN4319: The legislation amends the Crimes Code and the Judicial Code to provide for new offenses relating to railroad protection, railroad vandalism and interference with transportation facilities, and further provides for railroad civil immunity.  
Under the bill, a person who causes damage to railroad property and knew or should have known that it was railroad property, or if he causes a delay in railroad operations commits a misdemeanor of the third degree.  The bill also adds a subsection to
Title 42 to provide that a railroad owes no duty of care to a person who enters upon any railroad property or right-of-way without the consent of the railroad, or to give any warning to such person, nor shall the railroad be liable for any injury incurred. 
A 48-2 vote was recorded.

The following amendment was agreed to the prior to final passage and included in the final language of the bill:

A3439(Mellow): This is a technical amendment that clarifies language in the bill.   

Note: There was a motion to table the bill prior to the vote by Senator Logan.  The motion failed on a 21-29 party-line vote.

SB 1149, PN1675: The legislation amends the Tobacco Settlement Agreement Act to further provide for requirements that
 non-participating manufacturers (NPMs) place certain moneys into an escrow fund.  Under this bill, a NPM continues to
be required to place certain moneys into escrow and is only entitled to a release of such escrow amounts to the extent that
the NPM tobacco product manufacturer can establish that the amounts paid into escrow exceeded the Tobacco Master
Settlement Agreement payments that a NPM would have been required to make as a participating manufacturer under the
agreement.  A 50-0 vote was recorded.

SB 1190, PN1769: The legislation amends the Tax Reform Code to extend the employment incentive
tax credit.  The bill changes the hiring date of eligibility for employment incentive payments from December 31, 2004 to December 31, 2009. 
 A 50-0 vote was recorded.

SB 1192, PN1770: The legislation amends The Fiscal Code to provide for the authority of the Pennsylvania Treasury
Department to invest or reinvest the moneys of the Commonwealth.  Under the bill, the Treasury Department shall now invest
and reinvest the moneys of any fund, including equity securities and mutual funds consisting in whole or in part of equity
securities.  A 50-0 vote was recorded.

HB 1912, PN4143: The legislation amends Title 75 (Vehicles) as it pertains to person with disability plate and placard, for physical examinations, medical reports and incompetency determination. 
 The bill expands the scope of those eligible to certify a person’s disability in order to receive a handicapped parking plate or
placard.  Those now eligible under the bill include certified registered nurses, nurse practitioners or physician assistants
certified or licensed in Pennsylvania.  A 50-0 vote was recorded.

HB 2230, PN3040: The legislation amends the Emergency Medical Services Act to reflect a change in the section number
of the Vehicle Code.  The bill continues to impose a fee of $25 upon persons admitted to a rehabilitation program for driving
under the influence of alcohol or controlled substance, changing only the section number in Title 75 to reflect the passage
of Act 24 of 2003.  A 50-0 vote was recorded.

HB 2405, PN4284: The legislation designates the following bridges throughout the Commonwealth: the bridge carrying
State Route 248 over Aquashicola Creek in Palmerton Borough, Carbon County, as the Colonel John Craig Memorial Bridge;
the bridge over Chester Creek on State Route 926 in Westtown Township, Chester County as the L. Charles Scipione Bridge;
bridge on Pennsylvania Route 45 in Northumberland and Union Counties as the Judge Herbert W. Cummings/Judge Harold M. McClure Memorial Bridge; the bridge on which Main Street crosses Trout Creek in Slatington, Lehigh County as the General Thomas R. Morgan USMC Bridge; and the bridge over the Monongahela River,  known as the Clariton-Glassport Bridge, as the Senator Edward P. Zemprelli Bridge. 
The bill also designates a truck inspection station at 4262 Aramingo Avenue in Philadelphia as the Sgt. Jeffrey T. Ziernicki
Truck Inspection Station and a truck inspection station at 9200 Bartram Avenue after Sgt. Ziernicki.  A 50-0 vote was recorded.

HB 2654, PN4249: The legislation provides for powers of the Philadelphia Parking Authority.  The bill amends Title 53
(Municipalities Generally) pertaining to Chapter 55 (Parking Authorities) and Chapter 57 (Taxicabs and Limousines in First Class Cities).  The legislation also reenacts sections of Act 230 of 2002 that were included in Chapter 55 and Chapter 57.  A 30-20 vote was recorded.

known as Camp Security in Springettsbury Township, York County.

A3473(Brightbill): This amendment removes the Judiciary from the list of government bodies the resolution is directed to.  The amendment was agreed to.

The Senate concurred in House amendments to the following bill:

SB 769, PN1654: The legislation creates the Elderly Immunization Act, providing influenza vaccines for the elderly.  More specifically, when an eligible person is admitted to a hospital for a period of more than 24 hours, for a condition unrelated to the influenza virus, he or she shall be informed that they are eligible and provided the opportunity to receive a vaccine against the influenza virus before they are discharged.  A 50-0 vote was recorded.
