  The legislation amends the Mechanics’ Lien Law of 1963 to provide for the electronic indexing of waivers of mechanics’ liens.  The legislation provides that where a prothonotary’s office is computerized such that a party’s name can be retrieved regardless of whether that party is designated as a plaintiff or as a defendant, the indexing of the mechanics’ lien waiver document may be indexed as follows:

 

  • In the name of the owner as plaintiff and the contractor as defendant OR
  • In the name of the owner as defendant and the contractor as plaintiff.

 

The legislation amends the law to accommodate changes in technology since the Law was enacted in 1963.  A 48-0 vote was recorded.
