PASSED THE SENATE

 

HB 893, PN 3579: This bill would amend Title 66 (Public Utilities) by requiring state and local approval for terminations or transfers by municipal authorities.  Sen. Brightbill offered amendment A6000, which was technical in nature.  The Senate agreed to the amendment, and the bill went over as amended.

HB 1467, PN 3577: This legislation would provide for alternative dispute resolution procedures relating to residential construction defects between contractors and homeowners.  Sen. Gordner offered amendment A5983, which made the following changes: removes the prohibition against claimant introducing undisclosed defect evidence and provides for contractor second repair offer, makes the act prospective, requires that claimants receive testing notice and may be present during testing, requires that claimant receive copies of testing reports and evidence, removes a requirement that a claimant provide a specific reason for rejecting a repair offer, and makes clarifying changes to the construction defect notice provided upon entry into a construction contract.  A vote of 46-1 was recorded on the amendment, and a vote of 45-2 was recorded on the bill as amended.

SB 733, PN 1522: This bill would increase monthly payments to claimants under the Pennsylvania Occupation Disease Act by $25 to $150.  Sen. Gordner offered amendment A5975, which removed a $250,000 appropriation to the Department of Labor and Industry to provide for this bill’s benefit increase and changed the effective date of the bill.  The Senate agreed to the amendment, and the bill went over as amended.

SB 1025, PN 1523: This legislation would limit the authority of the Environmental Quality Board with regard to the Pennsylvania Clean Vehicles Program.  Sen. Madigan offered amendment A5830, which made the following changes: establishes CA-LEV II as the primary vehicle standard for the PA Clean Vehicles Program; authorizes continued use of the federal Tier II vehicle emission standard as a compliance alternative; requires future legislative action to continue the Clean Vehicles Program; requires DEP to report to the legislature on the state’s ozone standard attainment status under the Clean Air Act; requires PennDOT to provide the legislature with the number of vehicles, by county, certified by as CA-LEV II compliant; and incorporates definitions and exemptions to requirements of act that are identical to current language proposed by DEP.  A vote of 34-13 was recorded on the amendment, and the bill went over as amended.
