PASSED THE SENATE

 

SB 157, PN 1989  - This bill amends the Local Tax Enabling Act to further provide for the delegation of taxing powers and restrictions thereon.  The bill has been stripped of all prior language and now only provides under the section of the act that deals with an exception on sales of admission to places of amusement, an inclusion on the sales of admission to professional sporting events for a city of the third class (Allentown) with a population of not less than one hundred five thousand and not more than one hundred five thousand five hundred based on the 2000 federal decennial census.  A final vote of  50-0 was recorded on concurrence.

SB 1242, PN 2105 - This bill would add the County of Blair to the port district comprising the Port of Pittsburgh Commission.  The counties presently included are Allegheny, Armstrong, Beaver, Butler, Clarion, Fayette, Greene, Indiana, Lawrence, Washington and Westmoreland.  A final vote of 50-0 was recorded on concurrence.

SB 1331, PN 2166 - This bill amends the Tax Code to provide an exclusion from the sales and use tax for the sale at retail or use of copies of an official document sold by a government agency or a court.  A final vote of 50-0 was recorded.

HB 126, PN 4579 - This bill amends Title 71 (State Government) by further defining the term “alternative investment”, adding the term “alternative investment vehicle” and further providing for the administrative duties of the state employees retirement board by implementing limitations on information that is made public.  A final vote of 37-13 was recorded.      

HB 469, PN 4713 - The bill amends the Election Code providing for the date of application for absentee ballots, for voting by absentee electors, for canvassing of official absentee ballots and limiting contributions by partnerships, limited partnerships and limited liability companies.  Sen. Brightbill offered A9992 that changes the effective date for the absentee ballot provisions to January 1, 2007.  The amendment was agreed to and the bill went over in its order as amended.

SB 553, PN 2083 - The legislation establishes the Sexual Violence Victim Protection Act.  The legislation authorizes a sexual assault victim to petition the court requesting protection from the defendant.  A final vote of 50-0 was recorded. 

SB 592, PN 2044 - This legislation amends Title 24 (Education) by defining the term ‘alternative investment’ and ‘alternative investment vehicle’ and further providing for the administrative duties of the school employee’s retirement board by implementing limitations on information that is made public.  A final vote of 38-12 was recorded.

HB 632, PN 4757 - The legislation amends the Solicitation of Funds for Charitable Purposes Act, further providing for audit of certain financial reports.  A final vote of 50-0 was recorded.

SB 642, PN 2116 - The bill amends the Public School Code to set forth a process through which a school district may purchase land or buildings from a sitting school director.  Sen. Armstrong offered A9914  that adds a limitation that the school board member owned the land, building or both for at least 10 years.  The amendment was agreed to and the bill went over in its order as amended.

SB 647, PN 745 - The bill amends Section 1209 of the Public School Code to add certified registered nurse practitioners and physicians’ assistants to the list of professionals who can perform the physical tests needed by teachers in order to get their certification.  Sen. Conti offered A9860 that requires the Dept. of Education to prescribe a method of submitting a set of fingerprints for new applicants to the FBI, in accordance with federal law.  The amendment was agreed to and the bill went over in its order as amended.

SB 1095, PN 2113 - The bill provides clarification that companies (businesses) seeking rail infrastructure improvements to gain access to the rail network would be eligible for grants under this act.  A final vote of 50-0 was recorded.

SB 1110, PN 2164 - The bill amends the Administrative Code, providing for residency requirements for administrative agencies.  A final vote of 50-0 was recorded. 

SB 1330, PN 2165 - This measure would exempt bona fide law enforcement agencies, firefighter companies and other emergency personnel organizations from the prohibition of soliciting funds by the roadside.  A final vote of 49-1 was recorded.

HB 2042, PN 3962 - The bill increases the penalties for any person or municipality who negligently violates any provision of the Clean Streams Law or any regulation, order, or permit of the Department of Environmental Protection.   A final vote of 50-0 was recorded.

HB 2134, PN 4620 - This bill would limit the collection of Social Security numbers by state agencies and local governments, prohibit placing these numbers on health insurance cards, and provide for duties of the Department of Transportation.  Sen. Wonderling offered A9769 that clarifies that this act shall not prevent the collecting, using or release of Social Security numbers as it relates to Child Support Cases.  It also does not apply to PennDOT’s use for driver’s or nondriver licenses.  The amendment was agreed to and the bill went over in its order as amended. 

HB 2185, PN 3041 - The legislation amends The County Code by extending the time that a county controller has to submit its annual financial reports to the Department of Community and Economic Development from April 1 to July 1.  Sen. Browne offered A9958 prohibits a county or a municipality located within the county that is authorized to assess real property, from assessing a sign or sign structure primarily used to support or display a sign as real property for purposes of taxation by the county or political subdivisions within the county regardless of whether the sign or sign structure has become affixed to the real estate.  This amendment is retroactive to assessments for purposes of real property taxes levied and collected for fiscal periods of political subdivisions beginning on or after January 1, 2005.  The amendment was agreed to and the bill went over in its order as amended.  

HB 2186, PN 3042 - The legislation amends The Second Class County Code by extending the time that a county controller has to submit its annual financial reports to the Department of Community and Economic Development from the month of May to the month a July.  Sen. Browne offered A9957 prohibits a county or a municipality located within the county that is authorized to assess real property, from assessing a sign or sign structure primarily used to support or display a sign as real property for purposes of taxation by the county or political subdivisions within the county regardless of whether the sign or sign structure has become affixed to the real estate.  This amendment is retroactive to assessments for purposes of real property taxes levied and collected for fiscal periods of political subdivisions beginning on or after January 1, 2005.  The amendment was agreed to and the bill went over in its order as amended.

SR 366, PN 2162 - This is a resolution directing the Legislative Budget and Finance Committee to conduct a review of homeland security funding and preparedness in the Commonwealth.  A final vote of 50-0 was recorded.
