PASSED THE SENATE

 

SB 1140, PN 2194 - The legislation adds a section to Title 42 (Judiciary and Judicial Procedure) by establishing a central or regional booking fee, following the adoption of a countywide Booking Center Plan.  In addition to any other fines, penalties, costs or fees authorized by law, a person may be required by the court to pay a central or regional booking fee of no more than $200.  A final vote of 48-1 was recorded.

HB 552, PN 4820 - This bill amends the fiscal code to include definitions for general use prepaid cards, gift cards, gift certificates, and qualified gift certificates.  The bill also adds gift cards alongside gift certificates as being escheatable.  In order for a gift card or gift certificate to be escheated, it must have remained unredeemed for two years after its redemption period has expired, or unredeemed for 5 years after the date of issuance if no redemption period is specified. 

More importantly, this bill would exempt qualified gift certificates from the Commonwealth’s escheat law.  A qualified gift certificate is a gift card or gift certificate that does not contain any of the following: 1) an expiration date or period of time after which it expires, 2) any type of post-sale fee (dormancy fee, account maintenance fee, replacement fee, reactivation/activation fee).  Sen. Brightbill offered A10295 that provides language relating to notices of abandoned and unclaimed property.  The amendment was agreed to and the bill went over in its order as amended.

SB 668, PN 1623 - The legislation amends the Judicial Code to provide for the creation of a Statewide Jury Information System.  A final vote of 49-0 was recorded.

SB 1107, PN 1960 - This bill as amended in the Senate Agriculture Committee adds a definition of “local moneys” and “donated value” to the Agricultural Area Security Law.  Sen. Brightbill mad a motion to table the bill.  A final vote of 49-0 was taken on the motion. 

SB 1353, PN 2145 - This bill amends Title 62 (Procurement) to add a chapter providing for contracting with veteran-owned businesses and to impose certain duties upon the Department of General Services.  Each state affiliated purchasing agency shall have an annual goal of not less than 5% participation by veteran-owned businesses in all contracts entered into by the purchasing agency.  The Department of General Services is vested with 7 specific duties to support veteran-owned business participation goals and shall annually report in writing by October 1 to the General Assembly the awarding of veteran-owned contracts during the preceding fiscal year.  A final vote of 49-0 was recorded.

SB 1368, PN 2154 - This bill amends the Capital Facilities Debt Enabling Act to provide for debt limitation on redevelopment assistance capital projects.  The bill raises the cap on outstanding obligations for redevelopment assistance capital projects by $250,000,000 from $2,650,000,000 to $2,900,000,000.  A final vote of 32-18 was recorded.

HB 2090, PN 2880 - The legislation amends Title 34 (Game) by allowing the Game Commission to offer advertisements in any of their publications and media information.  A final vote of 49-0 was recorded.

HB 2186, PN 4818 - The legislation amends The Second Class County Code by extending the time that a county controller has to submit its annual financial reports to the Department of Community and Economic Development from the month of May to the month a July.  Sen. Orie offered A10275 that allows second-class counties determine its own smoking policies and exempt themselves from smoking policies in the gaming legislation.  The amendment was agreed to and it went over in its order as amended.

HB 2447, PN 3982 - The bill amends the Judicial Code clarifying certain costs associated with prosecution and, further adds to the requirements of the Megan’s Law website.  A final vote of 50-0 was recorded.

HB 2639, PN 4306 - Under this legislation, when a Pennsylvania laboratory tests a specimen to determine the serum creatinine level for a patient eighteen years or older, the director must calculate the patient’s estimated glomerular filtration rate and provide this information with its report to the health care professionals.  Sen. Armstrong offered A10108 that states there will be no additional charge for the testing.  The amendment was agreed to and the amendment went over in its order as amended.

HB 2667, PN 4848 - This bill amends the act of May 28, 1937, known as the Housing Authorities Law, by further providing for powers of the Authority and mixed-used projects.  A final vote of 49-0 was recorded.

SR 337, PN 2067 - This resolution is designed to send a concise signal to the U.S. Congress that the Commonwealth will not provide additional funds for the escalating cost of the North Shore Connector Project.  A final vote of 49-0 was recorded.

Supplemental Calendars

SB 157, PN 2206 - This bill amends the Local Tax Enabling Act to further provide for the delegation of taxing powers and restrictions thereon.  A final vote of 47-3 on the conference committee report was recorded.

HB 2186, PN 4880 - The legislation amends The Second Class County Code by extending the time that a county controller has to submit its annual financial reports to the Department of Community and Economic Development from the month of May to the month a July.  The bill also would allow Allegheny County to ban smoking in casinos.  A final vote of 48-2 was recorded.

SB 854, PN 2207 – This legislation would establish Strategic Development Areas that are designed to encourage capital investment, promote job creation and retention, and in the long run to provide a stronger tax base for the Commonwealth and affected municipalities.  The SDA’s are designed to promote key economic development projects similar to the Keystone Opportunity Zones (KOZ’s).  The bill gutted the language of the House version of property tax reform.  A final vote of 48-2 was recorded on concurrence. 

HB 700, PN 4884 – This proposal is a hybrid of lobbyist disclosure bills passed by the Senate and House earlier in the session.  Nearly all of the provisions included are similar to what the Senate and House have previously passed, reflecting an attempt to bridge the gap between the two versions on various substantive and procedural issues.  A final vote of 50-0 was recorded on concurrence.

SB 862, PN 2208 – This bill re-enacts the Senate version of the Gaming Reform with compromised changes that include elimination of suppliers.  A final vote of 50-0 was recorded on concurrence.

HB 2202, PN 4285 - This bill amends the Public Welfare Code, providing for home infusion therapy to be available to all eligible recipients and adding a definition of “home infusion therapy.”  A final vote of 50-0 was recorded.

HB 2282, PN 4869 - This bill amends the Tax Reform Code to further provide for a hotel occupancy tax and to provide for an exemption from the state income tax for emergency pay for members of the PA National Guard on active state duty.  A final vote of 50-0 was recorded on concurrence.

HB 471, PN 4885 - The bill establishes the Cardiovascular Disease Advisory Committee and a statewide stroke database.  Also there are provisions in the bill that allow local non-smoking ordinances to take effect in casinos.  A final vote of 50-0 was recorded.

HB 2699, PN 4366 - This act shall be known and may be cited as the Health Choices Act.  This bill authorizes and directs the Department of Public Welfare to establish and maintain a managed health care program for medical assistance recipients.  It also requires actuarially sound rates for certain managed care organizations, providing for the right of appeal and approval by the General Assembly of changes to the Commonwealth medical assistance plan, associated waivers and repealing inconsistent portions of other acts.  Sen. Costa offered A10032 that is the Senate Democrats version of Cover All Kids enabling legislation.  Sen. Brightbill made a motion to table the amendment.  A vote of 29-21 was recorded and the motion carried and the amendment was tabled.  Sen. Brightbill offered A 10328 that is a compromised watered down version of Cover All Kids that would not cover as many children as the Senate Democrats version and have higher premiums for working class families.  The amendment was agreed to and the bill went over in it’s order as amended.   

HB 2699, PN 4886 – This bill contains the compromised version of Cover All Kids.  A final vote of 50-0 was recorded.
