The legislation amends section 9904 of Title 42 (Judicial Code) to
further expand the use of the State Intermediate Punishment program.
The legislation authorizes the Department of Corrections at the time the
department takes custody of an offender and evaluates them for
classification as an offender who would have been otherwise eligible for
participation in the state intermediate punishment program. A 50-0 vote

disaster emergency, nothing in the legislation can be interrupted to
authorize the Governor to seize, take or confiscate lawfully possessed
